Section 2. To pay the cost of grading, curbing, paving and improving the streets, avenues and alleys (other than the in tersections and areas formed by the crossing of streets, avenues and alleys) in Street Improve ment District Nos. 103, 104, 106, 107, 110, 111. 112 and 115 in the City of Plattsmouth, Nebraska, there shall be and there are hereby ordered issued negotiable bonds of the City of Platts mouth, Nebraska to be called 'District Paving Bonds" of Street Improvement District Nos. 103, 104, 106, 107, 110, 111, 112 and 115 of the principal amount of Thirty Thousand Dol lars ($30,000.00) consisting of thirty bonds, numbered from 1 to 30 inclusive, being In the de nomination of $1,000.00 each, dated June 1, 1958 and the prin cipal of said bonds shall become due and payable as follows: Bond Nos. 1 to 8 Incl. $8,000.00 due June 1, 1959 Bond Nos. 9 to 12 incl. $4,000.00 due June 1, 1960 Bond Nos. 13 to 16 incl. $4, 000 00 due June 1. 1961 Bond Nos. 17 to 20 incl. $4, 000 00 due June 1, 1962 Bond Nos. 21 to 24 incl. $4, 000 00 due June 1, 1963 Bond Nos. 25 to 27 incl. $3, 000.00 due June 1. 1964 Bond Nos. 28 to 30 incl. $3, 000 00 due June 1. 1965 Provided, however, bonds num-! bered 25 to 30 inclusive, shall be ; redeemable at the option of the , City at any time on or after five years from date of issuance ; thereof. Attached to each of said bonds shall be interest coupons for the amount of the respective inter est payments to become due thereon and payable at the time said interest payments be come due. Section 3. Said bonds shall be executed on behalf of the City by being signed by the Mayor and City Clerk and shall have the City seal impressed on each bond. The interest coupons shall be executed on behalf of the City by being signed by the Mayor and City Clerk, either by affixing their own proper signatures to each coupon or by causing their facsimile signa tures to be affixed thereto. Section 4. The special assess ments levied upon the real es tate in said Street Improvement Districts and the interest on said assessments shall consti tute a sinking fund for the payment of the principal and interest of said bonds; the City agrees that it will collect said special assessments and in case the moneys collected therefrom are not sufficient to fully and promptly pay the interest and principal of said District Pav ing Bonds as and when such in terest and principal become flue, then the City will cause to be levied and collected annually a tax by valuation upon all the tax able property in the City, in ad dition to all other taxes, suffic ient in amount to fully pay the principal and interest of said bonds when and as such inter est and principal become due. Section 5. Said bonds and cou pons shall be substantially in the following form: UNITED STATES OF AMERICA STATE OF NEBRASKA COUNTY OF CASS DISTRICT PAVING BOND OF THE CITY OF PLATTSMOUTH STREET IMPROVEMENT DIS TRICT NOS. 103, 104, 106, 107, 110, 111, 112 AND 115. This bond is one of an issue of thirty bonds, numbered from 1 to 30 inclusive, of like date and tenor except as to maturity, of a total principal amount of Thirty Thousand Dollars ($30, 000.00) and is issued by said City for the purpose of grading, curbing, paving and improving the streets, avenues and alleys (other than the intersections and areas formed by the cros sing of streets, avenues and al leys) in Street Improvement District Nos. 103, 104, 106, 107, 110, 111, 112 and 115 in the City of Plattsmouth, Nebraska in strict compliance with Section 17-516 Revised Statutes of Ne braska 1943, and Section 10-126, Revised Statutes of Nebraska 1947 Supplement, and has been authorized by ordinances legally enacted and proceedings duly had by the Mayor and Council of said City. IT IS HEREBY CERTIFIED AND WARRANTED that all con ditions, acts and things required by law to exist or to be done pre cedent to and in the issuance of this bond, did exist, did happen and were done and performed in regular and due form and time as required by law, and that the indebtedness of said City, including this bond does not exceed any limitation impos ed by law. All special assess ments levied upon real estate in said Districts specially benefited by said improvements are valid liens upon the respective lots and parcels of real estate upon which they are levied, and shall, when collected, be set a side and constitute a sinking fund for the payment of inter est and principal of said bonds. The City agrees that it will col lect said special assessments and in case the principal and in terest of said bonds shall not be fully paid out of said sinking fund promptly, when and as such interest and principal be come due, the City will cause to be levied and collected annually a tax by valuation upon all the taxable property in said City, in addition to all other taxes, suf ficient to make up the deficiency and fully pay the interest and principal of said bonds as and when the same become due. The City Clerk is directed to make and certify in duplicate, transcripts of the proceedings of the City preced ent to the issuance of said bonds, one of which transcripts shall be filed with the Auditor of Pub lic Accounts of the State of Ne braska, and the other shall be delivered to Wachob - Bender Corporation. Section 7. The City Treasurer is authorized to deliver this is sue of bonds to Wachob-Bender Corporation upon receipt of pur chase price, in accordance with the contract entered into April 24, 1958, and sale of the issue is hereby confirmed. ORDINANCE NO. 965 AN ORDINANCE AUTHORIZ ING THE ISSUANCE OF INTER SECTION PAVING BONDS OF THE CITY OF PLATTSMOUTH, NEBRASKA, OF THE PRINCI PAL AMOUNT OF NINETY SIX THOUSAND DOLLARS ($96,000. 00) TO PAY THE COST OF GRADING, CURBING, PAVING AND IMPROVING THE INTER- SECTIONS AND AREAS FORM ED BY THE CROSS1NO OF STREETS, AVENUES AND AL LEYS IN STREET IMPROVE MENT DISTRICT NOS. 103, 104, 106, 107, 110, 111. 112 AND 115. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLATTSMOUTH, NE BRASKA: Section 1.
