the court was not tn session; that it la the'
right and privilege of every cltisen and
every newspaper to criticise every decision
of a court. Then Mr. T'unn. cited two
o-lntons by Judge fuliivan and Judge Hol
Comb. in which It waa held that tha pub
lic has a rteiht to criticise the official acts
of any- public servant.
Mr. Dunn then put on the soft pedal
and said the brief had been prepared very
hurriedly, probably a day being devoted
to iia dictation and it had been rushed
to the print r and then to Lincoln.
"1 meant no dJsrf-apect to this court or
to any member tf the-" court." ha said,
"and haj tha brief been prepared under
different circumstances I probably would
have el.m.nated some of the thing to
which tha court. I presume, took excep
tions," " Manr.bers of the bar are officers of the
court." said Judge Barnes, "and a different
rule applies to lawyers than applies to in

At the conclusion of trie Dunn speech,
Mr. Bumam claimed the attention of the
court:
"Mr. Dunn meant no dirre-pect to this
court or to any member of it," said Mr.
Bumam. "'. have knows Mr. Dunn for a
number of years and he ia a good lawyer
and a good citizen and a gentleman. He Is
a vigorous lawyer and when the case waa

busy and there waa little time for tha

Chief Justice Reeee, "where you practice
law for the losing side to make an attack
on the Judge who renders the opinion?"
"No. Indeed, it Is not," answered Mr.
Fumam. "and I am sure Mr. Dunn meant
no d.srevpect. He Is simply a vigorous
lawyer and his time as so lirr.itfd he was
unable to read over the brief carefully after
It had been dictated."

REPUBLICAN CITT, Neb., Nov. 15.
(Special.) In the district court of Harlan
county, held In Alma, Regnal Aable waa
found ruilty of stealing; merchandise of
T. M. Logan of this city. Aable took tha
goods from the store while be was clerking
for Logan and stored them at his farm
northeast 04 town. Later a search waa
made and tba goods found and recovered.
Aable was arrested and put under bonds
to appear In the district court. Tba bond
waa 82.000. Judge Imngan gave him a sen
tence of five years In the state penitentiary.

complaint against Frank Chamberlain,
charging him with shooting Miaa Mae Aus
tin, who & wounded last Thursday, with
lnttnt to commit murder. He will probably
be arraigned tomorrow. Miaa Austin ia
not out of danger.

LINCOLN. Nov. 15 1 Special.) The In
dictment of any person by a grand Jury
called in Nebraska at this time or at ar.y
time since the first regular term of the
district court following the adjournment of
the late legislature may be seriously ques
tioned in the courts. This state of af
fairs is due to the action of the late
democratic legislature In amending the law
providing for calling grand Juries and
very likely there can be no more grand
Juries called legally in Nebraska under
tbe present law.
Tbe amended law reads as follows:
"Station 1 grand Jury). Unless other
wise ordered in writirg by the court of a
Judge thereof, a grand Jury shall be drawn
andand summoned in tbe manner pro
vided by law. on the first day of the first
regular term of the district court of each
county 1 r tha state.
This section repealed section 584 o ft he '
criminal code of Nebraska, which provided
a Jud-e of tbe district court could call a
grand Jury at any time.
The flirt day of the first regular term i
of court has been interpreted to mean by ,
lamTere the first day of tha first regular
term of court following the adjournment !
of tbe legislature, ai.d these lawyers hold 1
that inasmuch aa criminal statutes are i
usually held by the oourt to mean what I
they aay literally, it is doubtful if an- !
other grand Jury can be called under the
present law.
In fact, the mater has already been put
up to one district Judge In a county where
there waa a murder committed, and he has
discovered that he has no lepal right
to call the grand Jury, and unofficially be
Is of the opinion the time has passed when
that county can have a grand Jury, he
having failed to call one on tba first day
of the first regular term.

was Introduced by Representative Wilson
of Polk county.
