irfraf Court Decision.
The supreme court today reversed the
case from Pottawattamie oounty of J. M.
Stevens against the Citizens Gas and Elec
tric company. In which the gas company
was appellant. Stevens was driver for the
chief of the fire department of Council
Bluffs. In responding to a fire at about
S o'cloujt the morning of September 17, 1904,
he drove Into a ditch or trench which the
gas company had opened In laying pipe
on 8outh First street. In the district court
Stevens won. The case I reversed on the
ground that the Judge erroneously sus
tained the objection to th offering In evi
dence of the city permit to open the streets,
and also on the instruction of the court
that anyone of the charge wer sufficient
to sustain a verdict If proven.

of this vicinity for th past forty yean,

merly conducted a mustard factory here,

he had been ill at the home of a brother
diagonally from his factory and house.

TABOR The funeral of H. H. Hunter

Mr. Hunter came to Tabor from Oberlln,

of nervous trouble, since when his health
had gradually declined and he passed awa
early yesterday morning. He leaves an
