meeting today developed the fact that there
exists an entlro misapprehension Concern
ing the legal proceedings which are to take
plnce In Chicago In tho case of Captain
Oherllu M. Carter, who was convicted by
military rourt-mnrtlal of embezzlement and
sentenced to n term lu the penitentiary at
Leavenworth, Kan.
Attorney General Knox explained to the
president and cabinet today that Captain
Carter was not to he given a new trial be
fore Judge Kohlsnnt, as has been errone
ously reported. The government attached
nbout $150,000 of tho property belonging to
Captain Carter, nnd tho question which will
bo tried bofore Judge Kohlnaat relates only
to the title to that properly. Incidentally,
of course, tho question of Captain Carter's
conviction by military court will he raised.

absolute harmony between the association ol
which he Is trustco and tho McKlnley
Memorial Arch association of this city, but
argued that In seeking popular subscrip
tions the former organization, whlrh plans
tho erection of a sultahlo monument at
Canton, should have tho right of way.
Senator Hnnna thought that about $750,000
tdiould be used In the crectlou of a suitable
monument.
While the cabinet was lu session today
Senator Hanna and Mr. Mtlburn spent some
tlmo with Secretnry Cortelyou, discussing
the plans of the memorial association, ot
which thoy ore trustees. It Is the Inten
tion of the association lo perfect an or
ganization In every state to raise funds
by popular subscription for tho natlon'i
tribute to tho mnrtyred president.

of Inquiry today Is transferring Its effects
from the gunners' workshop In the navy
yntd to the uptown quarters In tho McLan
building, Vermont avenue and H streets,
which will lio tho consulting quarttrs. No
effort will be made by the members of the
court even to confer upon the case, how
ever, beforo next Monday, as they arc In
need of mental nnd physical rest. The
court will nsl; the Navy department to
supply It with clerical n'ssslstnnce and a
stenographer to direct tho mechanlca1
work Involved In thn preparation pf the
report. In order that tho court may ab
solutely control such assistants, It Is T)i'fi!
