Carter, who was convicted by military rourt-mnrtlal of embezzlement and sentenced to n term lu the penitentiary at Leavenworth, Kan. Attorney General Knox explained to the president and cabinet today that Captain Carter was not to he given a new trial be fore Judge Kohlsnnt, as has been errone ously reported. The government attached nbout $150,000 of tho property belonging to Captain Carter, nnd tho question which will bo tried bofore Judge Kohlnaat relates only to the title to that properly.
