Deputy rish Commissioner Carbee and sev eral local officers reported yesterday an ex citing experience they had while attempting to arrest a number of Illegal fishermen at Manawa on Ttlcsdaj night During the aft ernoon Carbcc had received Intimation that number of professional fishermen had ar- rangtd lo iosl Ihelr seines In Ihe lake and ' resume their Illegal fishing , believing that there would bo no Interference on the part of the officer since the Manawa trains had ceased running The officer hustled around and secured the assistance of several consta bles and deputies and prepared for a raid. Thej reached Ihe lake at a late hour and taking a boat followed the gleam of a lan tern that was casting its rajs across Ihe walir from the opposite side of the lake. Thej bad been Informed that the fishermen were llible t' resent with force any Inter ference from the officers and approached Ihe lantern very taullously They found several fishermen In the act of pulling In a large net that was well filled with fish. The fishermen Haw them coming In time lo abandon Ihelr net and row for the shore. The officers left the net and pursued the boals containing the men , but could not overhaul them be- fo'e Ihej reached Iho shore. The fishermen abandoned the boats as soon as shallow water waa icached , waded out and disappeared In the willows A moment later a dozen shots were fired from the willows and the lead whistled all around the officers The fusil lade was returned and the ofllccrs plunged Into the willows awl made a hot chase aftc- the men who had fired on them The dense growth of willows formed too good a hiding place and the search was In vain. Yesterday the officers discovered who the men were and have procured wan ants for their arrest When they are found ihey will be placed under arrest charged with shootIng - Ing with Intent lo kill and Illegal fishing. Another feature of the ordinance which has caused considerable Ill-feeling because It has been misunderstood is the failure to Incorporate a clause providing for the pur chase by the cltj of the bridge and Ihe comranj's lines st s me future date There are no laws at the presant time that permit the cltj to purchase and own slreet rall waj s , and the provision could only have value as anticipating the enactment of such laws in the future. Section 7 confers this pov.er while bilnglng the companj under the complete control of the city. When ever the city asks the legislature for an enabling act to permit the purchase of the bridge and the lines lhat act will prescribe ! ! - Iho purchase shall be made , and the council by ordinance can name the dale of Ihe purchase The secllon Is the Joint work of three nttoincjs on the citizens' committee and CltjAtlorney Hazelton with the co operation ot Mayor Carson. An outdoor meeting was held last night to prolest against the passage of ordinances favoring the street car companies Resolu tions denouncing the council were adopted The city council met later and Immedi ately after reading the minutes the Manawa ordinance was taken up and put upon Its second reading At the conclusion of the reading Alderman Mctcalf arose lo a ques tion of privilege , ard said he had been In favor of granting the ordinance for the rea son that ho had born led to believe that the sections that provided for the control ot the road bj the council were as strong am ! complete us could be desired. He hsd bocT told , however , that such was not the CSHC and the sections alluded to were meaning less and worthless for the purpose deslgred , and ho called for the city attorney to I'-ike a statement in explanation of these p. jvi- slons Mr Hazelton responded and declared that ho , and ho ulone waa responsible for the sections , and as the legal adviser of the coun cil and servant of the people lie hid endeav ored to protect , the city's interest by I'raft- lug a section that would leave .10 doubt rs to who was the master , the city or the rail way company. The ordinance being In rondltlan for amendment Alderman Casper ofTeicd an amendment to section 4 , striking out Iho provision for a chance to evade the op ra tion of the Omaha trains around the I'lercc street loop after 1S9S AtKIns seconded , but a motion that the amendment io n > er under the rules prevailed and the ordinance laid over. Casper offered another amendment to strike out fifty years and Insert twcntj'.flve jears but got no second Alderman Casper proposed an amendment to the ordinance providing for a commutation bridge ticket making the bridge tolls 25 cents for one round trip Instead of 40 cents , the present ratf Sllll there was no second. There were no more amendments proposed and lht > ordinance went over umler the rules. The Manawa ordinance was then taken up and advanced to Its second reading At the conclusion of the reading of the ordi nance Alderman I'ace objected to section nine which gave the company the right to ube the franchise for the full term of liftj jtars for its Manawa line exclusive of any contingency that might affect the other po.- lions of the line. He wanted the city at. torney to draw an amendment that would make this portion of the line dependent upon the lifeof the transmlssiislppl line. Kmmctt Tlnlcy appealed for a fair considers , tlon and treatment. Alderman Atkins fa vored the amendment , and was supported by Alderman Casper , and It prevailed. Casper offered an additional amendment , substi tuting twenty-five jeara for fifty jears but there was no second.
