sioner bills have bcon prepared both
by the question of the constitutional

it is evident that they are satisfied

if they have no hope of tricking the
legislature , they may as well pack

inaries , the gentleman from Cheyenne ,
Mr. Biorbowor , was requested to take

Mr. Ohapln , of Franklin , who had

an assistant engineer , who thall bo on

After any amount of skirmishing
in regard to adjournment and printing
the governor's message , the whole
thing waa laid upon the table.
The aonato announced that Mernra.
McShano , Heist and Fisher had been
appointed a committo to confer with
n like committee on the part of the
house to consider the printing of the
governor's message. The ipeakor ap
pointed Messrs , Lee , Johnson and
Castle , from the h-uso , to act with the
senate committee.
Nearly $150 worth of time was then
consumed in the needless discussion of
the newspaper and atamp question ,
and it was finally disposed of uy laying

The announcomant from the atute
cupltol this morning of a do ( hit In
the Btato troa&ury produced a sensa
tion throughout the city. The follow
ing is thd report of the legislative
committee : The juint select committee -

daya and they are not advised when

They nlao have information from his
bondsmen , or some of them , that the
condition of the treasury is such that
they fdol justified to recommend that
the workings of the treasury be
stopped until an examination can bo
made. The deficit is thought will
roach $100,000.
At the luftt session of the legisla
ture a bill was introduced to Increase
the bond of the state treasurer , but
the bill waa stolen from the desk of
the clerk of the senate the night before
fore the bill was to come up for final
passage , on the day before
the day fixed for final
adjournment of the legislature. The
amount of the deficit in the treasury
cannot bo accurately ascertained until
a thorough investigation. One of the
bondsmen who has been cximinlt'g '
the accounts , aaya it ahowa thui far
a deficit of $380,000. The same bonds
man says the treasurer's backs and ac
count at ono of the batika eho"a a
discrepancy of over $30,000. Just
before Christinas ho said he
had drew out of the bank of

whcro they found that the ground bed
recently been disturbed. On remov
ing the aurface soil they found the
body of Dr. York nnd others , who had
boon murdered , burled iu those crude
graves. Hon. William Wright nnd S
S. Peterson , deputy United States
marshal at that time , followed the
wagon track across the open pralrlo to
Thaycr , Kansas , which ii about
twelve miles from the Bender houeo.
There they found the Bonders' wagon
and homes , which had been aban
doned. They tbero learned that the
Benders had taken the train on the
L. , L & G. railroad for the north.
The pursuing party telegraphed thu
conductor of the train , aind ho tele
graphed back that the Bendara had
stopped at Ohinntte or Now Chicago.
They next telegraphed the ticket agent
at Chicago or Chlnutto. Ho an
swered that ho had sold the Benders
tickets to Ghetopka , Kansas , which la
juat two .miles from the Ohorokoo line.
Messrs. Wright and Potcraon , after
obtaining this Valuable information ,
mounted their horses atid rode rapidly
back to the Bender place , where they
found Colonel York and Sheriff Stone.
The four men nt once procured fresh
horses and started iu dl has to for
Ohetopa. At Oawogo they again pro
cured freah hortoa and started anew
for Ohotopa , only distant eight miles.
Then they ascertained that the Benders -
dors had taken n team and wagon ,
which waa awaiting them there , and
had gone in a southeasterly direction
toward the Grand rlvor , in the Indian
nation. Ohotopa ia about thirty miles'
from the Grand river. When the
pursuing party reached Ohetopa they
were only about three hours behind
the Bondera. They pushed rapidly
ahead , aud the four men came up with
