A largo number of railroad commis sioner bills have bcon prepared both by the question of the constitutional ity of ouch a law ia having the if Feet to make all move slowly. The rail road attorneys are on the ground , but it is evident that they are satisfied that they cannot ; stem the tide , and if they have no hope of tricking the legislature , they may as well pack their grip-sacka and start for homo. A railroad attorney might have done a very little better if ho had had the cheek , but ho would not have changed it much , Lieutenant Governor Cams took every occasion to try to intuit Senator Reynolds , but ho did not nuke very much headway. Time and again the fate of the Bender < der family has been a question warm ly dobatflfMu all parta of the West , Many people maintain that the famllj were duly killed by the avengers ol Dr. York , whoso death first broughl to notice the murderous family. Not' withutanding this , every little whih comes the report that the Benders are still living and have been captured , There have been dlacoverod no leei than a hundred different Bender faml lies , and a collection of the nowspapa ) sensations relative to the dlscovcriei of Bondera would prove a moat inter' ' eating literary curiosity. The latos Bender sensation waa a local ono when the detectives of this city clap ped a guileless citizen into a ralaboosi upon the statement of a man name * Green. Ho was discharged from ens tody a few daya afterwards. The Benders kept an inn on a lone some road near Ohorryvalo , Libetti county , Kinois. The road paasoi f through the middle of a prairie , si : miles from Gherryvalo , aud all the iui travellers often stopped to get lodg ings for the night , Travellers stop plug there , supposed to have money were seated at the table , aud wbil they were taking their meala , a cur t tain which waa auiponded behim them showed the position of the ! heads. The bodies wer lowered into n collar underneat through a trap door , where the pocket wonld bo rifled of money and value blea and then the bodies were BURIED IN A HOLE dug in the lot In the roar of this hoi pltable tavern. The disappearance c Dr. York led to the discovery of thos terrible crimes and the sudden departure uro of the Bender family. Many statements of the manner 1 which tko Bondera mot their rotribc tlon have been made , but the circuu ftances of the affair have f jr a Ion time been enveloped in mystery. . new \erslon of the fate of the Boudoi sets the matter beyond all doubt. Colonel nel York stopped at the Bender place and made inquiriea for hla brother , the doctor Tno Botfdiira denied that ho had ever been there. Colonel York then wont to Independence , Montgomery county , Kon.- , and got Sheriff Stone. They both ( Colonel York and Sheriff S'ono ) made a viait to the Bonders. On arriving there they had n conversation with John Bender , nnd the information they pot from him waa unsatisfactory , hut enough waa obtained to AUOU8K THEIH RUHMOIONH. Oolonnl York nnd Sheriff Stone them returned to Independence and raised a party of men. They started out to Boiidur'a the very next morn ing , and when the party arrived nt tl.o place it WRB discovered that the fam ily had all decamped , 'Ihoy then hunted around the house , and finally prouectitod their search In the garden , whcro they found that the ground bed recently been disturbed. On remov ing the aurface soil they found the body of Dr. York nnd others , who had boon murdered , burled iu those crude graves. Hon. William Wright nnd S S. Peterson , deputy United States marshal at that time , followed the wagon track across the open pralrlo to Thaycr , Kansas , which ii about twelve miles from the Bender houeo. There they found the Bonders' wagon and homes , which had been aban doned. They tbero learned that the Benders had taken the train on the L. , L & G. railroad for the north. The pursuing party telegraphed thu conductor of the train , aind ho tele graphed back that the Bendara had stopped at Ohinntte or Now Chicago. They next telegraphed the ticket agent at Chicago or Chlnutto. Ho an swered that ho had sold the Benders tickets to Ghetopka , Kansas , which la juat two .miles from the Ohorokoo line. Messrs. Wright and Potcraon , after obtaining this Valuable information , mounted their horses atid rode rapidly back to the Bender place , where they found Colonel York and Sheriff Stone. The four men nt once procured fresh horses and started iu dl has to for Ohetopa. At Oawogo they again pro cured freah hortoa and started anew for Ohotopa , only distant eight miles. Then they ascertained that the Benders - dors had taken n team and wagon , which waa awaiting them there , and had gone in a southeasterly direction toward the Grand rlvor , in the Indian nation. Ohotopa ia about thirty miles' from the Grand river. When the pursuing party reached Ohetopa they were only about three hours behind the Bondera. They pushed rapidly ahead , aud the four men came up with the fugltivea four milei from the Grand river , and there without further ceremoney the Benders met the retri bution duo their crimoa. They were all shot to death , and the bouea of old man Bender , liia wife , John and Kate , lie there in u hole dug in the ground , where they remain at this day.Mr. Mr. Wright la now living in Iowa and Peterson ia a resident of Indo pendoccs , Kansas.
