Lincoln to face murder charges in connection with her
disappearance on Oct. 3, 1974.

"denied the defendant a right to a fair trial."
This included testimony about a note linking Ellis to
Foryckl when the evidence itself wasn't made available to
Ellis until immediately before the trial, the motion stated.
He also objected to what he called "prejudicial evi
dence" including reports of hair samples obtained from
his ex-wife'a car, testlmbny about previous crimes Ellis
had allegedly committed, as well as testimony from doc
tors concerning manners of death and the possibility of
suicide.
The request for a new trial also challenged Judge Wil

evidence.
