The Dean fo the Division of Stu dent Affairs or his repre , sentative shall present each case to the Tribunal which presentation shall contain a written statement of the facts prepared and signed by the defending student unless the defending student refuses to prepare and sign such a state ment. 2. Time and Place. The Chairman of the Tribunal shall fix the time and place for each hearing. The Secre tary of the Tribunal shall mail, at least five days prior thereto, notice of such time and place to the defending student and to the Dean of the Division of Student Affairs, unless such notice is waived. 3. Adjournments. The Chair man of the Tribunal for good cause may adjourn the hear ing upon the request of the de fending student or the Dean of the Division of Student Af fairs or upon his own initia tive. t . , 4. Representation by Coun sel. The defending student may be represented by coun sel at the hearing if he so de sires 5. Order of Proceedings. The Chairman of the Tribunal shall read the statement of facts prepared and signed by the defending student. The Dean of the Division of Stu dent Affairs or his representa tive shall then present any additional facts. The Chairman may, in his discretion, vary this pro cedure but shall afford full opportunity to all for the pres' entation of any material relevant proofs. 6. Evidence. The defending student and the Dean of the Division of Student Affairs may offer such evidence as they desire and shall produce such additional evidence as the Tribunal may find neces sary to understand and deter mine the case. All evidence shall be taken in the presence of the defending student ex cept where he is absent in default or has waived his right to be present. 7. Absences. The hearing may proceed in the absence of the defending student if he fails to be present or fails to obtain an adjournment. In the event that the defending stu dent and the Dean of the Di vision of Students Affairs agree that the statement of facts prepared and signed by the defending student contains all the facts necessary for the disposition of the case, nei ther the defending student nor the Dean of . the Division of Student Affairs need by ores ent unless expressly request ed by the Tribunal. No hear ing shall proceed unless there are present at least tour stu dent members and one fac ulty member of the Tribunal, 8. Attendance of Hearings. Persons having a direct inter est in the case are entitled to attend hearings. Upon the written request of the defend ing student the hearing shall be open to the public, in tne absence of such request, it shall be discretionary with the Tribunal to determine the propriety of the attendance of any persons not having a di rect interest. The Chairman of the Tribunal shall have the power to require the retire ment of any witness during the testimony of other wit nesses. 9. Closing of Hearing. The Chairman of the Tribunal shall specifically inquire of the defending student and the Dean of the Division of Stu dent Affairs or his represent ative whether they have any further evidence to offer or witnesses to be heard. Upon receiving negative replies the Chairman shall declare the hearing closed. 10. Reopening of Hearing The hearing may be reopened by the Chairman of the Tri bunal on his own motion or upon the application of the de fending student or the Dean of the Division of Student Ai fairs for good cause shown at any time before the decision is rendered. II. The Decision 11. Time. The decision shall be rendered promptly, not lat er than thirty days after clos ing the hearing. 12. Form. The decision shall be in the form of a written recommendation addressed to the Dean of the Division of Student Affairs, signed by the Chairman and the Secretary of the Tribunal. 13. Scope. The Tribunal may make any decision which it deems just and equitable in cluding, but not limited to, expulsion from the University for a fixed time, conduct pro bation for a fixed time, con duct warning, or dismissal of the charges. 14. Majority Decisions. A de cision of the Tribunal shall be by a majority vote except that in the case of a decision rec ommending expulsion or sus pension a two-thirds vote is required. 15. Delivery of the Decision. The Secretary of the Tribunal shall deliver the decision to the Dean of the Division of Student Affairs. The Dean of the Division of Student Affairs shall inform the defending student of the decision as well as his own disposition of the case. The Dean of the Divi sion of Student Affairs shall also notify the Tribunal of such disposition. III. Special Provisions 18. Record. The Secretary of the Tribunal shall keep a rec ord of each case in a separate file. The record shall show the place, time, and date of the hearing, the presence of the defending student and coun sel, if any, the presence of the Dean of the Division of Main Feature Clock State: "Never Ota Sunday," 1:37, 3:35, 5:33, 7:31, 9:29. The file con taining such record shall be kept in an appropriate place, not open to the public inspec tion. 17. Amendmnets.
