NE BRASKA, AUTHORIZING THE ISSUANCE OF SEWER BONDS OK SAID CITY OF THE PRIN CIPAL AMOUNT OF TWO HUN DRED THOUSAND DOLLARS ($200.0001) TO PAY THE COST OF CONSTRUCTING A SEW AGE DISPOSAL PLANT AND SANITARY OUTLET SEWER IIY SAID CITY PRESCRIBING THE FORM OF SAID BONDS AND PROVIDING FOR A LEVY OF A TAX TO PAY THE SAME. HE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF PLATTSMOUTII, NE BRASKA: Section 1. The Mayor and Council of the City of Platts mouth hereby find and deter mine: That the City of Platts mouth is a City of the Second Class; that pursuant to a Re solution of Necessity which was duly proposed and passed by the Mayor and Council of said City there has been constructed a sewage disposal plant and sani tary outlet sewer for said City; that said improvements have been completed in accordance with the plans and specifica tions and contract therefor and have been accepted by the City; the total cost of said improve ments was $28(3,792.38. Part of the cost has been paid by the Federal Government and other funds and after applying the same to the cost ot said im provements there remains due and unpaid from the City an amount in excess of $200,000.00; that all conditions, acts and things required by law to exist or to be done precedent to the issuance of the Sewer Bonds of the City of the amount provided for in this ordinance to pay for said improvements do exist and have been done in due form and time as provided by law. Section 2. Bonds Nos. 1 to 37 both in clusive shall bear interest at the rate of tour per centum (4) per annum, said Interest to be represented by one set of cou pons; Bonds Nos. 38 to 63 both inclusive shall bear interest at the rate of four per centum (4) per annum from date until March 15, 1963, and at the rate of two and three-fourths per centum (2ai) per annum thereafter until maturity, said Interest to be represented by two sets of coupons, one for 2- per annum from date until maturity and the other for 1 1 per annum from date until March 15, 1963, which latter coupon shall be marked A and may be detached and sold sep arately; Bonds Nos. 64 to 102 both inclusive shall bear in terest at the rate of four per centum (4) per annum from date until March 15, 1963 and at the rate of three per centum (3) per annum thereafter until maturity, said interest to be represented by two sets of coupons, one for 3 per annum from date until maturity and the other for 1 per annum from date until March 15, 1963. which latter coupon shall be marked A and may be detached and sold separately; Bonds Nos. 103 to 147 both inclusive shall bear interest at the rate of four per centum (4) per annum from date until March 15, 1963, and at the rate of three and one-fourth per centum (3') per annum thereafter until maturity, said interest to be re presented by two sets of cou pons, one for VaK per annum from date until maturity and the other for i of 1 per an num from date until March 15. 1963, which latter coupon shall be marked A and may be de tached and sold separately; Bonds Nos. 148 to 200 both in clusive shall bear interest at the rate of four per centum H"i) per annum from date until March 15,.1963,:.and. at the rate of throe and forty-nun-, dredths per centum (3.40) per annum thereafter until matu rity, said interest to be repre sented by two sets of coupons, one for 3.40 per annum from date until maturity and the other for .60 per annum from date until March 15, 1963, which latter coupon shall be marked A and may be detached and sold separately. Said interest shall be payable semi-annually on the 15th day of March and Septem ber of each year. Section 3. Said bonds shall be executed on behalf of the City by being signed by the Mayor and Clerk and the City seal shall be attached to each bond. Attached to each bond shall be Interest coupons for the amount of the Interest payments there on and falling due at the time such Interest becomes due, and such coupons shall be executed on behalf of the City by the Mayor and Clerk either by af fixing their own proper signa tures to each coupon or by caus ing their facsimile signatures to be affixed to each coupon, and the Mayor and Clerk shall by the execution of each bond be deemed to have adopted as and for their own proper signatures their facsimile signatures on the coupons attached to such bonds. Section 4. INSERT IN BONDS 38 to 63 both inclusive: "four per centum (4) per annum from date until March 15, 1963, and at the rate of two and three-fourths per cen tum (2) per annum thereafter until maturity, said interest to be repre sented by two sets of cou pons, one for 2 per an num from date until matu rity and the other for 1 ,4 per annum from date to March 15, 1963, which latter coupon shall be marked A and may be detached and sold separately." INSERT IN BONDS 103 to 147 both inclusive: "four per centum (4) per annum from date until March 15, 1963, and at the rate of three and one-fourth per centum (3V4) per annum thereafter until maturity, said interest to be repre sented by two sets of cou pons, one for 34 per an num from date until matu rity and the other for 3 of 1 per annum from date until March 15, 1963, which latter coupon shall be marK ed A and may be detached and sold separately." INSERT IN BONDS 148 to 200 both inclusive: "four per centum (4) per annum from date until March 15, 1963, and at the rate of three and forty-hundredths per centum (3.40) per an num thereafter until matu rity, said interest to be re presented by two sets of coupons, one for 3.40 per annum from date until maturity and the other for .60 per annum from date until March 15, 1963, which latter coupon shall be mark ed A and may be detached and sold separately." said Interest being payable semi-annually on the 15th day of March and September of each year. Bonds Nos. 38 to 200 both inclusive shall be redeemable at the option of the City in inverse numerical order at par and ac crued interest at any time on or after September 15, 1966. Both the principal hereof and the interest hereon are payable at the office of the County Treasurer of Cass County in Plattsmouth, Nebraska. For the prompt payment of this bond, principal and interest, as and when the same become due, the full faith, credit and resources of said City are hereby irrevoc ably pledged. ! This bond is one of an issue of 9W1 hnnris numbered from 1 to 200 Inclusive of the total prin cipal amount of $200,000, of even date and like tenor herewith except as to maturity and rate of interest, which arc Issued by said City for the purpose of pay ing the cost of constructing the sewage disposal plant and sani tary outlet sewer for said City in accordance with the provi sions of Section 17-925, Reissue Revised Statutes of Nebraska, 1943, and the statutes of said State applicable thereto and the issuance of said bonds has been lawfully authorized by proceed ings duly had and .by an ordin ance duly passed; signed' and published by the Mayor and Council of said City. The City agrees that it will levy and collect annually upon all the taxable property in said City in addition to all other taxes a tax which will be suffi cient to pay the Interest and principal on said bonds as the same become due. Said tax shall be known as tiie Sewer Tax and shull be payable annually lu money. IT IS HEREBY CERTIFIED AND WARRANTED that all con ditions, acts and things required by law to exist or to be done precedent to and in tne issue or this bond, did exist, did happen and were done and performed in regular and due form and time as required by law. and that the indebtedness of said City, including this bond, does not exceed any limitation im posed by law. IN WITNESS WHEREOF, the Mayor and Council of the City of Plattsmouth, Nebraska, have caused this bond to be executed on behalf of the City by boing signed by its Mayor and attested by its Clerk and by causing the corporate seal of the City to be affixed, and have caused the Interest coupons hereto attach ed to be executed on behalf of the City by having affixed there to the facsimile signatures of its Mayor and Clerk, and the Mafor and Clerk do by signing this bond adopt as and for their own proper signatures their respec tive facsimile signatures affixed to said coupons. After being execut ed by the Mayor and Clerk, said bonds shall be delivered to the City Treasurer who shall be res ponsible therefor under his of ficial bond. The Treasurer shall cause said bonds to be transmit ted to the State Auditor of Pub lic Accounts of the State of Ne braska with the certified trans cript and shall cause said bonds to be duly registered in said Auditor's office and in the of fice of the County Clerk of Cass County. Section 7. The Mayor and Council shall cause to be levied annually upon all the taxable property in said City a tax which shall be sufficient to meet ; payments of interest and prin cipal of said bonds as such in terest and principal become due. Such tax shall be known as the Sewer Tax and shall be paid an nually in money. Section 8. The said bonds hav ing been sold to The First Trust Company of Lincoln at not less than par, the Treasurer is au thorized to deliver the bonds to said purchaser upon full pay ment for the same. Section 9. This ordinance 6hall take effect and be in force and effect from and after its pass age according to law. PASSED AND APPROVED this 8th day of September, 1961. NEWS From EAGLE Mrs. John Fischer Phone 984-6141 Mr. and Mrs. Rudolph Umland and son of Kansas City, Kan., visited during the Labor Day weekend at the home of her parents, Mr. and Mrs. Henry Rockeubach and also other rela ives, during their stay. All are former Eagle residents. Sharon Wall of Atkinson, Neb raska spent Labor Day weekend, at the home of her father, Har old Wall, and Glenda returning to Atkinson, on Monday after noon. Harold Wall enjoyed a trip to Stockton, Calif., via Scottsbluff, where he spent overnite visiting relatives and continued on to Stockton for a week with rela tives and friends during his vac ation. Mr. and Mrs. Jim Bogenrief of Cheyenne, Wyoming visited at the home of his mother, Mrs. Lance elites and Mr. elites, overnite last Monday evening. The guests also visited her rela tives at Hebron Nebraska and a former neighbor of Mrs. Boger nrief sereral years ago at Fair bury, Nebr. enroute home. Mr. and Mrs. Herman Kirch hoff attended a family reunion of relatives, the Minderman's honoring the visiting Hillman cousins from Ogallala and Wake eney, Kansas, on Sunday at Minden, Nebraska. Mr. and Mrs. Ronald Johnson, are parents, of a son, Jeffrey Dale. He has a brother, Randy, 20 months old. Mrs. Johnson is the former Sharon Ostrander. Maternal grandparents are Mr. and Mrs. Lloyd Ostrander and paternal grandparents, Mr. and Mrs. Elmer Johnson, both of Lincoln, formerly of Eagle. Maternal great-grandparents are Mr. and Mrs. William Malone and great-great-grandfather, Jacob Schuster, all of Eagle. The parents are both Eagle grad uates. Mrs. Edwin Neeman returned home from the hospital, last Wednesday afternoon, after her second entry to the hospital fol lowing a major surgery. She is now recovering satisfactorily Mr. and Mrs. Richard Cochran and daughter, of Newton, Iowa visited at the home of his broth er, Mr. and Mrs. Robert Coch rans on last Friday and Satur day, returing home Sunday mor ning via, Tecumseh Nebr., to get their son, who will enter Grinell Univ. this fall. Mr. and Mrs. Dana Schnieder and sons, Tim and Danny of Oconomomoc, Wisconsin visited Monday evening at the home of her parents, Mr. and Mrs. John Vickers. Mr. and Mrs. Eldon Fleishman and son Jerry, of Elmwood, visit ed at the home of her parents, Mr. and Mrs. Clarence Vader Saturday evening. Mr. and Mrs. Eddie Vader and daughter Susie of Lincoln visited at his parents the Clarence Vaderson Friday evening. The two grandchildren remained at the grandparent's home on Monday, while the parents attended the State Fair at Lincoln. Eagle friends of the Henry Lohmeier family were sorry to hear of Mrs. Lohmeier's death last Sunday at Lincoln. She was 49 years old, and they resided at Eagle on a farm, where the Robert Kumefs own now east of Eagle. Their son Don Lohmeier attended Eagle Schools when re sided here. Funeral services were held Tuesday afternoon at Lin coin. Visitors at the home of Mrs. Bessie Mocroft and William Ma lone recently were Miss Anna West of Seattle, Wash., and Mrs. Hazel Moore of Leavenworth Wash., who were school friends of Mrs. Mocroft where they re sided on East "O" St., 50 years ago. The guests were making a Nebraska trip and made the ef fort to spend a few hours, visit ing, reminiscing and enjoying the time together (all were school teachers). Mr. and Mrs. Roland Halvor sen and family and his parents Mr. and Mrs. John Halvorsen of Palmyra, attended a family ga thering on last Friday evening at Palmyra, Nebr., honoring the Lloyd Stretch family, visiting from the western part of Ne braska. She had accompanied Mr. and Mrs. Lester Frohlich of Lincoln, who visited at the brother's home the previous week. Mr. and Mrs. H. D.
