That Central Electric and Gas Company, a corporation, its suc cessors and assigns, hereafter referred to as grantee, be and is hereby granted the non-exclusive right, privilege and authority for a period of twenty-five (25) years to construct, build, operate and maintain a natural gas system and all appurtenances necessary and incidental thereto and any and all necessary mains, pipes, services, and all other appliances thereunto appertain ing, including the right to use all existing mains, pipes, ser vices, and all other existing gas appliances of every kind and description belonging to the Cen tral Electric and Gas Company, in, upon, over, across and along the streets, alleys, bridges and public places of the City of Plattsmouth, Nebraska, for the receipt, distribution, transpor tation, transmission, conveyance and sale of natural gas for lighting, heating, industrial and all other uses and purposes in said City, and the right, privi lege and authority for said period to use and occupy the streets, alleys, avenues and public places of said City as they now exist or as they may hereafter exist for the aforementioned purposes and public uses, subject however, to the control and supervision of the City Council as to the man ner, location and places to be so used and occupied. SECTION 2. The grantee, its successors and assigns, shall lay their pipes, mains, and other natural gas equipment and apparatus and so locate the same in the streets, avenues, alleys and public places of the City in such a manner as not to obstruct or interfere with any water pipes, sewers, drains, or other structures already in stalled or hereafter to be in stalled, and grantee shall, so far as may be practicable, avoid interfering with the use of any street, alley, or other highway where the paving or surfacing of the streets shall be disturbed. In case of any disturbance of pavement, sidewalk, driveway or other surfacing, grantee shall, at its own cost and expense, and in a manner entirely satis factory' to the City, replace and restore all paving, sidewalk, driveway or surface of any street or alley disturbed, in as good condition as before said work was commenced, and shall main tain same in said condition for a period of five (5t j'ears; and in this behalf grantee agrees and shall post and deposit with the City, at the discretion of the City Council, any reasonable bond or undertaking, the amount thereof to be fixed by the City Council, which may be required from time to time by said City, guaranteeing and insuring the fulfillment of the terms and ob ligations hereof, and saving, pro tecting and indemnifying and Real Estate and Insurance WM. In event that at any time during the term hereof the City shall lawfully elect to alter or change the grade of any street, avenue, public place or highway, grantee shall upon reasonable no tice to be determined by the City Council, remove, relay and relocate its mains or ser vice pipes, wherever possible, and where the same shall be made necessary by reason of any change of grade and the en tire cost and expense of such relocation and relaying of any mains or pipes shall be paid by grantee. SECTION 3 Grantee shall and hereby agrees to make such reasonable extensions of its mains from time to time and install services to the curb lines where mains are located in streets, and to prop erty lines where mains are lo cated in alleys, as may be reas onably required to furnish ser vice to prospective applicants located within the corporate limits of City; provided, how ever, grantee shall not be re quired to make any such exten sions of its mains which will require the installation of more than one hundred feet of mains for each consumer to be served thereby, providing such consum er contracts to use gas service for at least one year, and con sumer located more than one hundred feet from the mains of said Company, may install his own private line to connect with said main; said private line to be the property of said consumer and maintain it at his own expense; same to be paid and installed according to the specifications of grantee and under the rules and regulations of said City. SECTION 4. The City of Plattsmouth at all times shall have and reserve the right, power and authority to establish, regulate, control, direct or otherwise by ordinance or resolution, legislate concern ing rates or charges for such natural gas service in the said City or any lands or territory at any time subject to its juris diction. In determining said rates or charges the franchise rights as such shall not be con sidered as having any value or bearing thereon and shall not be considered at any time as relevant or material for said purposes. SECTION 5. That at all times during the period of this franchise the grantee shall serve and furnish gas to its customers at such pressure and shall be sufficient for lighting, heating, industrial, and domestic purposes: in the event the pressure shall be in sufficient thereof for a period of sixty days, the City may at its option, terminate, cancel and annul this franchise; in the event the grantee herein shall at any time during the period of this franchise, without fault Which of m was Is yours a small or large office? Grantee agrees to furnish and install for its gas customers ac curate and reliable meters and to keep the same in proper re pair without any cost to any customer; and all meters shall ' at all times be subject to in- j spection by the City, and the! City shall have the right to 1 test said meters at reasonable I times. Whenever any consumer ! shall request the City in writing ! to test the meter on his service, j such test shall be made by the j City and if said meter is found I to be incorrect on such test, ; then grantee to pay the cost of such test, otherwise the cost of j such test to be borne by the consumer. I SECTION 7. j Grantee in the construction, operation and maintenance of its ; natural gas system, equipment . and appliances in said City, shall ; use and employ only modern. I standard and approved pipes,' material and equipment and all necessary modern and standard safety devices to protect said City and its inhabitants from damages and injury, and same shall meet with the approval of the City Engineer or such other persons as the Council may designate to inspect same. SECTION 8. In the event of a shortage in the supply of natural gas for any reason beyond the control of the grantee, it will allocate the available gas, in cooperation with the municipal authorities, in a manner to conform to the general' interests of the public. SECTION 9. Grantee at all times agree to protect, indemnify and save harmless the municipality from and against all claims and de mands, and from all loss and ex pense arising out of the negli gence of the grantee in the con struction, installation, removal. operation or maintenance of any ! mains, pipes or gas equipment during the term hereof. SECTION 10. Within ten days from and after the passage and approval of this ordinance, grantee shall prepare and file an unqualified written acceptance hereof with the Clerk of the City, and failure to do so shall be considered a rejection hereof by grantee, and the rights and privileges hereof shall thereupon terminate.
