Board met pursuant to ad journment. Present C. V. Stoehr, Parr Young and A. G. Rcid, County Commissioners, Geo. R. Savies, County Clerk. Minutes of last session ap proved, when the following busi ness was transacted in regular form: OFFICIAL BOND of Richard C Peck, Acting County Judgo, approved. Resolution WHEREAS the Chicago, Bur lington and Quincy Railroad Company has made a demand in writing to the County Treasurer Wm. S. WETENKAMP Real Estate and Insurance Res. Dial 51TC Office So. 6th St. Plattsmouth ; of Cass County for the sum of $400.25 alleging said sum to be due claimant as a refund on the First Half of 1947 personal taxes paid by said claimant on pro i.perty owned by it in said County I of Cass, Nebraska, as more par I ticularly set out in the demands made, copies of which are attach ed hereto and made a part hereof, and WHEREAS the total levy for the year 1947 made under L.B. 397, Serial Number 230, Laws of 1947. was fixed by the Board of County Commissioners of Cass County, Nebraska at .50 mills, and WHEREAS subsequently thereto an Attorney General's opinion holding that said levy could not be legally mr.de for the year 1947 was rendered, and WHEREAS said claim appears proper and claimant is entitled to a refund of $400.25 by virtue of said questioned lew. NOW THEREFORE BE IT RESOLVED that the County Treasurer of Cass County. Ne braska be and she hereby is au thorized to refund the sum of $400.25 to the Chicago.
