July 1, 1947 Board met pursuant to ad journment. Present, C. W. Stoehr, Parr Young and A. G. Reid, County Commissioners, Geo. R. Sayles, County Clerk. Minutes of last session approv ed, when the following business was transacted in regular form: , STATEMENT of Surveys by the County Surveyor for the pe riod January 1, 1947, to July 1, 1947, received and placed on file. STATEMENT of the County Institute Fund for the period July 1, 15945, to July 1, 1947, was filed by the" Cduhty Superintendent of Schools showing receipts $225.35, expenditures $114.65, and balance June 30th, $110.70. OFFICIAL BOND of Ed Free man as Constable for Weeping Water City approved. RESOLUTION WHEREAS, Federal Funds hava been made available by the j j Federal Aid Highway Act 1944 I for the improvement of Second i ary and Feeder Roads located on a system of such roads selected by the Department of Roads and Irrigation in cooperation with the County Boards and the Public Roads Administration, and WHEREAS, the Federal share payable on account of any proj ect provided for by the funds made available under the provi sions of this Act shall not exceed 50 percentum of the construction cost thereof other than costs of rights of way, and as to cost of rights of way shall not exceed 13 of such costs, and WHERE, the road described as follows: beginning at Highway U. S. 34, at a point approximate- HOME and FARM PROPERTIES at AICTIOQ ALVA VENNER ESTATE WEDNESDAY JULY 16 2:00 o'clock p. m. Referee. ly one mile south and one mile west of the Village of Nehawka, Nebraska, which point is legally described as the Northwest cor ner of Section-Thirty (30), Town ship Ten (10) North, Range Thir teen (13) East of the 6th P.M. and extending South two miles on the West Section Lines of Sec tions Thirty (30) and Thirty-one (31) in Township Ten (10), North, Range Thirteen (13) East of the 6th P.M. and the East Sec tion Lines of Sections Twenty five (25) and Thirty-six (36) in Township Ten (10) North, Range Twelve (12) East of the 6th P.M. and terminating at the Cass Otoe County Line has been estab lished in conjunction with the County Board of Cass County, in accordance with the provisions of the Federal Aid Highway Act of 1944, and WHEREAS, the regulations for carrying into effect the provi sions of the above act permit the use of funds other than State Funds in matching Federal Funds for the improvement of these sec ondary roads, and WHEREFORE, in view of the above it is the desire of the Coun ty to utilize the one mill levy heretofore made for the purpose of improving secondary roads, to match Federal Funds made avail able by the above act for the construction of said roads. NOW, THEREFORE, be it re solved that the County Board of Cass County,, Nebraska, hereby makes said funds available for the improvement of Secondary Road herein described under the provisions of the Federal High way Act of 1944 and request the I State of Nebraska Department of Roads and Irrigation to secure concurrence of the public roads administration for said project. AGREEMENT THIS AGREEMENT, made and entered into by and between Cass County, hereinafter referred to as the "County", Party of the First "Part, and the State of Ne braska Department of Roads and Irrigation, hereinafter referred to as the "State", Party of the Second Part. WITNESSETH: WHEREAS, Federal Funds have been made available by the Federal Aid Some Xj 1 mm w v. v isl Highway Act of 1944 for the im provement of secondary and feeder roads located on a sys tem of such roads selected by the Department of Roads and Irriga tion in cooperation with the County Boards and the Public Roads Administration, and WHEREAS, the Federal share payable on account of any proj ect provided for by the funds made available undefr the provi sions of this Act shall not exceed 50 percentum of the construction cost thereof other than costs 01 rights of way, and as to cost of rights of way shall not exceed 13 of such costs, and WHEREAS, a system of sec ondary and feeder roads have been established in conjunction with the County Board of Cass County in accordance with the provisions of the Federal Aid Highway Act of 1944, and WHEREAS, the regulations for carrying into effect the provi vions of the above Act permit the use of funds other than State funds in matching Federal funds for the improvement of these secondary roads, and WHEREAS, the above mention ed regulations for carrying into effect the provisions of the Fed eral Aid Highway Act of 1944 further require that the Depart ment of Roads and Irrigation shall be the contracting agency, shall supervise and inspect the construction, and that the Feder al share of the cost of any proj ect shall be paid only to the State, and WHEREAS, in view of the above it is the desire of the County to utilize (Give the na ture, source and amount of the funds, 1 Mill levy and other Coun ty Funds to match Federal funds made available by the above Act for the construction of a section of road located on the Nehawka South road beginning at the northwest corner of Section 30, T.10N, R.13E and extending south 2 miles to. the Otoe-Cass County line, and identified as Project No. S-228(2). NOW, THEREFORE, in consid eration of these facts and the mutual dependen covenants herein contained the parties hereto agree as follows: Section 1. The State, without cost to the County, agrees and is hereby authorized to make the necessary preliminary survey, prepare all plans and advertise and receive bids for the work. Section 2. Contracts for any new or additional right of way shall be obtained by the County.
