Eldred, McCook, to preside at the trial of Charles Hutter, accused of slaying Grant Fallon, Fikhorn farmer, last December. Eldred was assigned to the case following request by Attorney Gen eral Walter R. Johnson and Asst. Atty. Gen. Rush C. Clarke that a judge outside the fourth Judicial district (Douglas county) be ap pointed. The petition was filed after District Judge Henry Beal, before whom the case formerly was tried, reduced from first degree murder to manslaughter the charges against Hutter. The jury subsequently was unable to arrive at a verdict. Eugene O'Sullivan, defense at torney, appealed yesteraay against the court's action, arguing that all the facts were not presented, and hat the order damaged the trial court and his client.
