, 'l'owle promptly agreed with him
, - and stated that hc would be willing -

pcnse of pang if the other property -

1Ir. Jenne realized that . Mr.
. 'fowlc's willingness in the matter
meant a great deal and he at
once began to push thc "mattcr.
He drew up a petition and circu-
, J tcd it among thc property own-
' ers and that petition and thc sig--
na lures secured arc as follows :

_ l state of Nebraska , do hereby
agree to pay thc amounts that it
i will cost to pave Stone street of
. thc said halls City from thc
Union hotel comc011 : Third street
to the Ciristian church corner on
Seventh street , including cross
streets , 'l hird , Fourth , Fifth and
Sixth , which shall be paved to
t thc alleys on thc cast side , and
also on thc west side of said Stone
street.

ty owners arc to pay for thc paving .

"And it is further provided that
this contract shall not bc binding
upon the undersigncd unless thc

ty of Richardson shall pay for

the supervision of the mayor and

' And it is hereby understood
1 t and agreed by all parties con-
, I 4 corned , that thc said paving shall
be lone in the following manner ,
to wit : First , there shall bc four
01' live inches of broken rock ,
which shall bc evenly spread and
rolled with a heavy steel roller uf
sufticient weight to thoroughly
press said stone into thc earth.
On top of said layer of stone
there will be a layer of sand , next
a layer of paving' brick laid flat
with the two inch way laid per-
pendicular. On this ; another laver -
cr of sand , and then another layer -
er of pang brick with thc four
in way perpendicular , thc whole
to be rolled and sanded sufficiently -
ly ] to make good paving.
HAnd it is further agreed that
if property owners adjoining
Stonc street , in blocks 38 and 31)
and blocks 26 and 2-7 , will sign
this petition and contract , Stone
street will be paved to First strect.
And it is i also agreed that if prop-
crt\ owners in blocks 122 and 123
adjoining Stone street , will sign
this petition and contract , Stone
street will be paved to Big'hth
strcct.

.It is further agreed and understood -
derstood that the city of Falls
City. Richardson county , and
state of Nebraska , shan be to all
expense in paving the squares
and crossings of cress streets as
far as the paving shall extcnd ,
and also to be to all expense in
surveying ; and grading where
streets are paved under this con-
tract. '
HIt is further agreed that said
paying shall be fully completed
before any of the undersigned
shall bc compclled to pity for any
part of said paving' .
"It is hereby understood that
the said paving shall be com-
mcnced as soon as convenient and
if possible not later than April
