LARGE NUMBER OF CASES I MAYTERM DISTRICT COURT I Seventy Cases on the Doclten to be Tried at Present Term of Court Which Convened Monday DENNIS MURDER CASE DlSMIS.SED. : The May tcrm of District court in and for Custer count- , Judge Bruno O. Hostetler Prt'- siding , convanec1 here Monday. On the calendar are forty-oue jury cas s , of which four are criminal , amI thirty-one courl cases. It would require more than thc time alloted for court to try this number of cases , by some judges , but Judge Hostetlcr is very punctitlious , keeps thc at- torQeys close to the work and manages to accomplish a con siderable amount of business in a brief space of time , hence it " thought all cases on the calendar will be given a hearing before adjournment. Considerable interest was manifest - fest in the case in which Charles and Harv y Dennis , father and 12-year old son , were charged with the murder of George Morrison , which occurred in the extreme southwest part of the county last May. Trouble arose between Dennis and Mo'rrison on the location of a line fence and ! \'lorrison was Idllec1 by a shot- from a gun claimed to have b ell fired by the boy at the command of his father. Auotlltr son , John , was tried at the last term of court on the samc charge and acquitted by the jury. On call of : ecase , , Monday , County Attorney - torney Guttcrson filed nolle prossqui as against the father i and son and the case against them wa' , dismissed. Link Trotter waltzed on the carpet 'I'uesday , charged with grand larceny. It was claimed that last February he found a purse containing the sum of $90 , belonging to A. G. Spencer ; tbat l'rottet' was cogni7ant of the owner's name , but regardless thereof converted the sum to his own personal use , thereby COUl- mitting th crime of grand larceny. Tuesday a jury was sworn and the evidence taken , an evening session being held. Yesterday morning the plea of attorneys was made and , after considerin ' for five hours the jury returned a verdict of not guilty. Joseph Schall , alias "Friday , " a roustabout , has been in jail here since February awaiting trial on the charge of shooting with intent to kill. It is claimed he filted up on "squirrel" whiskey and terrorized the village of Anselmo , whereupon W. 1.1. Lewis , the marshal , and a posse sought to arresst him. He was in possession of a Colt's automatic - matic revolver and opened fire which resulted in winging the marshal.- one of the bullets 101g- ging in his leg. "Friday" k'pt the posse at bay and by boarding a moving train , escaped to Dunning - ning where he was met by the whole population , artned with every conceivable kind of weapon , and he gave up without resis- tance. Uj Smith and Henry Graut- man had ' been doing a farming stunt 'as partnersj batching , cooking , sleeping , eating , dreaming - ing and hobnobbing together , but each thougbt the other was gcttin . the best of him. The result was a faU-out and a conflict - flict in which Smith fired a couple of shots at Grautman , one taking effect , but m r ly crippling - pling him1for the time being. 'rhe court , after consideration of the reasons filed and after con- consultation with the twelve jurors who tried John Dennis , and after being fully advised in the premises , sustains the reasons - sons filed by the county attorney and said. prosecution was c1 s- missed. Court found $50 due plaintiff on cause of action , which was for damages on account - count of tressliass of defendant's cattle. M. H. Glassey vs. Jackson Dye. Agreed that case shall be tried next Monday , the 27th. Jesse Scott vs. Custer township. Case dismissed upon application of plaintiff at Ilaintiff's costs. In the matter of the estate of John E. Shaw. Application to sell land to pay dr-bts. 'l'he court finds allegations of petition true. , Lavanda H. Babcock vs.JoS. . Babcock , Divorce was granted as prayed and custody of minor c.i1dren . awarded plaintiff. An , Interesting Convention. ( ConlrllJIIIClI. ) The 23rd Annual CusterCo 1Uty Sunday School cOI1\'ention that assembled in thc city 'l'hursday and lj\riday of last week was one of the most spir tual and helpful meetings the association has ever hcld. 'rhe program as carried out did not differ much from the published one , except having to lilt in the place where Prof. 1-1. M. Steidley , field secrerary , of Lincoln , had a part , and because ot his sickness this was made necessary. But 'with a large number of efficient helpers present - sent , and .working . .Miss Mamie Haines , state primary supt. , over time , the prog raJu was rendered very satisfactorily. Yet we missed the Prof. , who has come to be known in the various parts of the county. 'l'he reports of county ot1icers as to the work for the past year was very gratifying - ing and showed progre and advancement in the various de- partments. 'rhe pledge made a year ago of $150 for statC' work had been ver.v nearly raised , and the small ballance was vcry' quickly raised by finance com- mittee. There have been eleven district conventions held in the five districts during the year. Quite a few schools have taken up the Home and Primary or Cradle Ron departments dUring the year. Several Normal or teacher training classes have been established since last con- vention. 'l'he attendance of delegates was the largest in the history of the association , there being fifty-four enrolled , besides a large number of visitors not delegates.
