a brief filed in support of a petition

Southern and Central Pacific proper

If the present properties were
disintegrated after SO years of unified
and uninterrupted operations," the
brief said, "the effect would be to
create two managements where tnere

raw and untried condition which has

Two Lines Unified.
"Not only were the two roads
built, operated and controlled by the
rame persons," but the Southern
Pacific was constructed as a continu
ation of the lines of the Central Pa
cific, and "to prevent duplication,"
counsel' argued, adding that the
builders proceeded upon the assump
tion that the lines would be operated
together and through the "SO years
of their existence the properties have
never been other than a unified
whole, made up of integral parts
which were the outcome of a normal,
natural growth."

The brief objected to the use of the
word "combination" in the opinion
of the court, in reference to a con
solidation of two systems," insist
ing that the case presented only "the
building of integral parts of a prop
erty." Numerous Citations.
Numerous citatipns were given to
support the alleged rights of the
Central Pacific as a California cor
poration, to lease its property to the
Southern Pacific, free of restriction
by federal statute, the contention be
ing made that the lease was like
many other made by California
companies holding federal franchises
to construct and operate railroads
which "have stood unchallenged from
earliest times."
Declaring it was not the intention
of the Sherman, law "to subvert titles
vested before its passage,',' the brief
presented an exhaustive argument
to support the contention that the
- lease of the central Pacific to the
Southern Pacific was validade in
1885 for a period of 99 years and that
the arrangement could not be inter
fered with until the expiration of the
lease. r ,

stor, coupled with the big vote he
received in country districts is re-
ported to be taken ny nominees as
proof of ability to get the facts con-.
cerning the state government before
the voters in the fall campaign.

Aviator Scalped in Mishaps
Formerly Lived in Fairbury
Fairbury, Neb., Aug. 1. (Special.)
Rube Wagner, the aviator scalped
in an accident at Tarkio, Mo., Fri
day, is in St. Elizabeth hospital in
St. Joseph, Mo. He is an orphan and
has always made his home with his
grandparents, Mr. and Mrs. Ruben
Quinn, of Fairbury.
. Physicians say that he has a fair
chance to recover. An attempt will
be made to graft the scalp on as
soon as he gets stronger.
,. Rube left here in 1917 to enter the
government aviation service and has
been in the service of an Omaha
aviation company since his discharge
from the army.

Leonard Miller, son of Mr.

jured while participating in athletics

fected leg in Methodist hospital in
Omaha yesterday.

Assessment Totals to Be Les

Lincoln, Aug. 1. (Special.) Ne
braska land -valuations will be lower
this year than they were last year,
This was the statement made to
day by W. H. Osborne, state tax
commissioner, following an all-day
conference with the state board of
eaualization relative to valuation re
ductions requested by 35 counties. A
hearing on reductions was hem won
dav at Lincoln.
"I do nJt mean all reductions re-
auested will be granted. Osborne
said. "This will not be the case. But
there will be a decrease in total val
uations placed on Nebraska land this

The reduction in valuation, logcm
rr with almost a 33 1-3 per cent re
duction in the state levy to be made
bv the state board of equalization,
is made possible by the special ses
sion of the legislature called by Gov
ernor McKelvie last winter wncn
millions of dollars were sliced trom
appropriations.

bank robbery in Wahoo. is "broke"
and unable to support his wife and
child, his attorney told counsel for

leased on his own recognizance.

The outstanding feature of a
raid staged by Sheriff Mike
Clark's deputies Monday on a
farm house one mile west of Fair
acres was the work of "NannyV
goat alleged to be the (lookout."
Nanny did not like the way Dep
uty Sheriffs Hove, Dworsky,
Quackenbush and Johnson entered
the farm. For she at once began,
to act.
While the deputies were search
ing the premises, Nanny saw
Quackenbush's' coat lying on a
chair in one of the outbuildings.
Sticking its nose in one of the
pockets Nanny smelled something,
and began to chew.
Dworsky heard the noise and
when he investigated Nanny had
swallowed part of the- pocket as.
well as a newly bought package of"
chewing tobacco.
"I didn't' mind the coat, but I
sure did miss the tobacco," said
Quackenbush. '
The officers seised 50 gallons of
hootch, three complete stills, 30
barrels of masn and 100 empty bar
rels. Sam Gauto and Usy Sprospa
were arrested .and released on
$1,000 bonds.
The liquor was made in a long
cave between two barns, the of
ficers said.
