Execution of 1lie supreme court order requiring iht Southern Pacific company o li vrit iisrlf of ownership and control of the Central Pacific railway would Hive retroactive effect to the Sherman niti-trut law and "create a new and untried condition" in the manage ment of the two roads, according to a brief filed in support of a petition lor a rehearing of the cane. Joint control and operation of the Southern and Central Pacific proper I n, counsel for the defendants con tended, had been in effect long be fore the law wai enacted under which the legality of such control finally wat attacked. If the present properties were disintegrated after SO years of unified and uninterrupted operations," the brief said, "the effect would be to create two managements where tnere ri been but one since the origin of ' lite properties and also to create a raw and untried condition which has rt) prototype." Two Lines Unified. "Not only were the two roads built, operated and controlled by the rame persons," but the Southern Pacific was constructed as a continu ation of the lines of the Central Pa cific, and "to prevent duplication," counsel' argued, adding that the builders proceeded upon the assump tion that the lines would be operated together and through the "SO years of their existence the properties have never been other than a unified whole, made up of integral parts which were the outcome of a normal, natural growth." ;it would be the irony of fate," the .brief continued, "if it should turn out that the unified control of Stan ford and hia associates were At stroyed by their stock sales" (refer ring to the transfer of Central Pa ," cific stock, mostly to foreign invest ors) "and then find that the restora tion of this unified controlvby repur chase of the stock was illegal." ' The brief objected to the use of the word "combination" in the opinion of the court, in reference to a con solidation of two systems," insist ing that the case presented only "the building of integral parts of a prop erty." Numerous Citations. Numerous citatipns were given to support the alleged rights of the Central Pacific as a California cor poration, to lease its property to the Southern Pacific, free of restriction by federal statute, the contention be ing made that the lease was like many other made by California companies holding federal franchises to construct and operate railroads which "have stood unchallenged from earliest times." Declaring it was not the intention of the Sherman, law "to subvert titles vested before its passage,',' the brief presented an exhaustive argument to support the contention that the - lease of the central Pacific to the Southern Pacific was validade in 1885 for a period of 99 years and that the arrangement could not be inter fered with until the expiration of the lease. r , Davis Is Proposed for G. 0. Osborne, state tax commissioner, following an all-day conference with the state board of eaualization relative to valuation re ductions requested by 35 counties. A hearing on reductions was hem won dav at Lincoln. "I do nJt mean all reductions re- auested will be granted. Osborne said. "This will not be the case.
