Vttoo, Neb, May 21. Tte em-
paneling of a jury in the TIanley case
was abandoned this ' afternoon on the
arrival of Col. Smythe with Judge
Ilallenbach. of Fremont. The former
then made a motion to quash tbe in
dictment, on the ground that it did not
show that the offense alleged had been
committed with felonious intent. Tbe
court overruled the motion, and set
7:30 p. m. for the hearing of a motion
for a chansre of venue.' At that hour
Col. Smythe appeared with Mr. Hallen
bach, who has been taken in the case
and asked the indulgence of the court
as he bad net really had time tq pre
pare for the case, to allow him to move
for a continuance. In the morning he
claimAh would show ample grounds
for the granting of the same. The
court granted the request. At the
latter hour the motion for a change" ot
venue will also be argufed. Failing in
gaining a continuance or obtaining
change of venue, tbe'ease will go im
mediately to trial. 7 ,
