making of a contract for street light
ing in the City of O’Neill, Nebraska
with the Interstate Power Company
of Nebraska, a Delaware corpora
tion, and to repeal Ordinance No.
115A of the City of O’Neill, Nebras
ka.
Be it ordained by the Mayor and
Council of the City of O’Neill, Ne
braska :
Whereas the Interstate Power
Company of Nebraska, a Delaware
corporation is desirous of furnishing
equipment for lighting the streets
in the City of O’Neill, Nebraska, and
furnishing electrical energy therefor,
and said City is desirous of purchas
ing electrical energy for lighting its
streets from said company.
And whereas the said City and said
Company desire to enter into a valid
contract for said purpose and to be
authorized by this Ordinance,
And whereas the said proposed
contract is in words and figures as
follows, towit: '
STREET LIGHTING AGREEMENT
THIS AGREEMENT, made and en
tered into this 14th day of February,
1930, by and between INTERSTATE
POWER COMPANY OF NEBRAS
KA, a Delaware Corporation, with
offices at Dubuque, Iowa, its success
ors and assigns, hereinafter called
the "Company,” and the CITY OF
O’NEILL, HOLT COUNTY, STATE
OF NEBRASKA, hereinafter called
the “Municipality.”
WITNESSETH:
JHAT, WHEREAS, the Company
now owns and operates an Overhead
Street Lighting System within the
Corporate limits of said Municipality
consisting of fifty-two (52) Suspen
sion Fixtures with 80 C. P. 6.6 Series
Lamps and two (2) 100 C. P. 6.6 Ser
ies Lamps and twenty-eight (28)
White Way Standards equipped with
250 C. P. 6.6 Series Lamps.
WHEREAS, the Municipality de
sires that the Company shall operate
said Street Lighting System.
NOW, THEREFORE, for and in
consideration of the mutual coven
ants and agreements herein contain
ed, it is hereby mutually agreed by
and between the parties hereto as
follows:
I. That the Company shall oper
ate and maintain said Street Light
ing System (including- the renewal of
lamps) and furnish electric energy
for the same, in accordance with the
following schedule, to-wit:

II. That the Municipality shall pay
to the Company, each month for
maintaining and operating said Street
Lighting System and furnishing elec
tric energy thereto during the term
of this contract, a consideration com
puted upon the following schedule of
rates, to-wit:
For each 250 C. P. White Way
Standard burning from Dusk until
Dawn, $4.80 per Mo.
For each 100 C. P. Overhead Lamp
burning from Dusk until Dawn, 32.12
per Mo.
For each 80 C. P. Overhead Lamp
burning from Dusk until Dawn, $1.94
per Mo.
Provided that said consideration
shall not be less than the sum of Two
hundred Thirty-nine Dollars and Fif
ty-two cents ($2,39,52) each month
during the term of this contract.
III. That the Company shall, as
soon as practical after the end of
each month, render a bill to the Mun
icipality for the operation and main
tenance of said Street Lighting Sys
tem and White Way Standards and
the furnishing of electric energy
thereto during the preceding month,
and the Municipality shall pay said
bill within Five (5) days following
the first ensuing Meeting of the City
Council.
IV. That the Municipality hereby
represents that it has taken due and
proper action, in accordance with the
Statutes of the State of Nebraska, to
appropriate sufficient funds for the
payment of bills to be rendered here
under and it agrees that if such funds
shall be insufficient for that purpose
it shall, at the time and in the man
ner and to the extent provided by the
Statutes of said state, appropriate
additional funds and assess, levy and
collect a tax sufficient for the prompt
payment of said bills.
V. That the Company shall, upon
proper written request therefore
from the Municipality, instalf addi
tional overhead and White Way
Street Lighting equipment and main
tain, operate and furnish electric
energy thereto at the rates herein
above specified; provided, however,
that the Company shall not be requir
ed to ii1 -<tall any such additional
street lighting equipment during the
last year of the term of this contract,
or of any extension thereof, unless
the Municipality 'hall give notice to
the Company, evidenced by a certi
fied copy of resolution or ordinance
passed by its governing body, that it
is going to and had elected tQ renew
this contract for a period of not less
than Five (5) years, and provided
further that the Company shall not
be required to extend its street light
ing circuit further than three hun
dred (.‘1001 feet for each additional
street light.
\ I. That the Company shall oper
ate and maintain said overhead and
White Way Street Lighting System
at its own cost and expense, and shall
patrol said system at least once each

week and promptly replace all brok
en or burned out lamps.
VII. That the Company shall ren
der good and sufficient service for the
purpose of this contract but shall not
be liable^for failure of such service
due to causes beyond its control.
VIII. That this agreement shall
be and remain in full force and effect
for a period of Five (5) yeai's from
and after the time when energy shall
first be delivered hereunder, provid
ed, however, that ^he term hereof
shall be extended an additional Five
(5) years if the Municipality shall
not, within Thirty (30) days prior to
the expiration hereof, notify the
Company in writing of its desire to
terminate the same at the end of
said Five (5) years.
IX. That all contract and agree
ments, written or oral, heretofore ex
isting between the parties hereto and
covering the subject matter hereof,
(if there be any such), are hereby
cancelled, and the Municipality here
by represents that it has by appro
priate action repealed or amended all
ordinances, resolutions and rules, or
parts thereof, heretofore adopted by
it in conflict with the terms hereof.
X. That the Municipality repre
sents that this agreement has been
duly authorized by a majority vote of
its City Council in accordance with
the Statutes of the State of Nebras
ka, certified copies of the proceedings
therefore shall be promptly furnish
ed to the Company for approval of
its Council.
XI. If any Section or part of a
Section of this agreement shall be de
clared null and void by any compe
tent authority, the remaining por
tions hereof shall not be affected
thereby.
IN WITNESS WHEREOF, the
parties hereto have caused this agree
ment to be executed by their respect
ive officers thereunto duly authoriz
ed and their respective corporate
seals to be hereunto affixed, the day
and year first above written.
Therefore, BE IT ORDAINED BY
THE MAYOR AND COUNCIL OF
THE CITY OF O’NEILL. NEBRAS
KA, AND BY SAID CITY:
Section One: That the City of
O’Neill, Nebraska does enter into the
aforesaid contract for lighting its
streets with the Interstate Power
Company of Nebraska, a Delaware
corporation, and that the Mayor and
City Clerk of said City execute said
contract on behalf of said City of
O’Neill.
Section Two: That Ordinance No.
115A of the City of O’Neill, Nebras
| ka be, and it is, repealed,
l Section Three: This ordinance
shall be in force from and after its
passage and publication as provided
by law.
