An Ordinance providing for the making of a contract for street light ing in the City of O’Neill, Nebraska with the Interstate Power Company of Nebraska, a Delaware corpora tion, and to repeal Ordinance No. 115A of the City of O’Neill, Nebras ka. Be it ordained by the Mayor and Council of the City of O’Neill, Ne braska : Whereas the Interstate Power Company of Nebraska, a Delaware corporation is desirous of furnishing equipment for lighting the streets in the City of O’Neill, Nebraska, and furnishing electrical energy therefor, and said City is desirous of purchas ing electrical energy for lighting its streets from said company. And whereas the said City and said Company desire to enter into a valid contract for said purpose and to be authorized by this Ordinance, And whereas the said proposed contract is in words and figures as follows, towit: ' STREET LIGHTING AGREEMENT THIS AGREEMENT, made and en tered into this 14th day of February, 1930, by and between INTERSTATE POWER COMPANY OF NEBRAS KA, a Delaware Corporation, with offices at Dubuque, Iowa, its success ors and assigns, hereinafter called the "Company,” and the CITY OF O’NEILL, HOLT COUNTY, STATE OF NEBRASKA, hereinafter called the “Municipality.” WITNESSETH: JHAT, WHEREAS, the Company now owns and operates an Overhead Street Lighting System within the Corporate limits of said Municipality consisting of fifty-two (52) Suspen sion Fixtures with 80 C. P. 6.6 Series Lamps and two (2) 100 C. P. 6.6 Ser ies Lamps and twenty-eight (28) White Way Standards equipped with 250 C. P. 6.6 Series Lamps. WHEREAS, the Municipality de sires that the Company shall operate said Street Lighting System. NOW, THEREFORE, for and in consideration of the mutual coven ants and agreements herein contain ed, it is hereby mutually agreed by and between the parties hereto as follows: I. That the Company shall oper ate and maintain said Street Light ing System (including- the renewal of lamps) and furnish electric energy for the same, in accordance with the following schedule, to-wit: Number Size in Use of Lamp Hours of Burning 28 250 C. P. From Dusk until Dawn every night 52 80 C. P. From Dusk until Dawn every night 2 100 C. P. From Dusk until Dawn every night II. That the Municipality shall pay to the Company, each month for maintaining and operating said Street Lighting System and furnishing elec tric energy thereto during the term of this contract, a consideration com puted upon the following schedule of rates, to-wit: For each 250 C. P. White Way Standard burning from Dusk until Dawn, $4.80 per Mo. For each 100 C. P. Overhead Lamp burning from Dusk until Dawn, 32.12 per Mo. For each 80 C. P. Overhead Lamp burning from Dusk until Dawn, $1.94 per Mo. Provided that said consideration shall not be less than the sum of Two hundred Thirty-nine Dollars and Fif ty-two cents ($2,39,52) each month during the term of this contract. III. That the Company shall, as soon as practical after the end of each month, render a bill to the Mun icipality for the operation and main tenance of said Street Lighting Sys tem and White Way Standards and the furnishing of electric energy thereto during the preceding month, and the Municipality shall pay said bill within Five (5) days following the first ensuing Meeting of the City Council. IV. That the Municipality hereby represents that it has taken due and proper action, in accordance with the Statutes of the State of Nebraska, to appropriate sufficient funds for the payment of bills to be rendered here under and it agrees that if such funds shall be insufficient for that purpose it shall, at the time and in the man ner and to the extent provided by the Statutes of said state, appropriate additional funds and assess, levy and collect a tax sufficient for the prompt payment of said bills. V. That the Company shall, upon proper written request therefore from the Municipality, instalf addi tional overhead and White Way Street Lighting equipment and main tain, operate and furnish electric energy thereto at the rates herein above specified; provided, however, that the Company shall not be requir ed to ii1 -
