Morton, his wife, first and full name unknown, defendants, the object and prayer of which is to have a judgment order of the district court of Holt county, Nebraska, made on the 27th day or April, ..905, found of record in said court, in Journal 22, at page 565, in an action then pending in said court for the foreclosure of a certain mortgage executed by Pitt L. Purdy during his lifetime and Susan Anna Purdy, his wife, upon north half of the northeast quarter (Ni NE$), and east half of the northwest quarter, (EjNWi),of section thirty-five (35), in township twenty-six (26), north of range fifteen (15), west of the Sixth (6), P, M. in Holty county, Nebraska, for the sum of $500, together with in tertest, Wherein this plaintiff was plaintiff and said defendants were de fendants for the reason the dismissal of said petition was obtained by Wil liam R. Butler who falsely and fraud ulently represented to the court that he was the duly authorized attorney for all the defendants, when in fact he had not been employed by them nor any of them. To whom it may concern: The following resolution was passed by the county board November 24, 1908: Whereas, The high water caused by ice gorge in the Niobrara river has suddenly injured and damaged both the bridge and roadway on the public road across the north branch of the Niobrara river at the Lynch or Red Bird bridge. And Whereas, The road cannot be traveled without a bridge at this place, therefore, in the opinion of this board, an emergency exists aud that the publio requires immediate action, and to prevent any inconvenience and damage, I move that we proceed to repair the same, and the proper notice be published declaring the intention of this board to contract tor repairing the same.
