Morrissoy Is a young chap who has no reputation as a lawyer, never sat on tho Judlcjal bench, and only camo into prominence as tho private secretary to tho gov ernor, which to say tno moat is a lackey's Job. In order to appoint Morrlsspy tho govornor turned down a number of Judges and lawyors who aro among tho moat ablo men of the Btatc; among theso being Judgo "VVcst ovcr, Judgo KUllger, Judge Oldham, W. II. Thompson, doim J. iiaingan and others equally prominent. It is gcnorallly conceded that tho govornor waa forced to appoint Morrissoy by tho Lincoln democratic gang that HoeniB to havo tho governor under its thumb. Tunnel Work to be Kcsiimcd. Tho Kllpatrlcks, contractors on tho Guorneoy tunnel line, will rcsumo work on tho construction of that piece of railroad February 1, and it 1b now expected that work will continue with out interruption until tho nino miles of road, with more than a mllo of tunnel, la ready for oorvlco. Ono of theso tunnels is 3.G00 feet in length, another 1.G00 foot in length, and tho other moro than 1,000 foet In length. Tho road when completed will com plete tho Nebraska system with tho new low grado lino through Wyoming. Work was stopped on this lino last fall when tho war tied up the financial resources of tho world. Tho contrac tors wero permitted to closo tho work so that resumption will not bo a lang drawn out task. Committee Holds Meeting Tho commltteo in chargo of tho lec turo courso met Wednesday morning to nrrango plans for tho next number of tho courso and talk over tho final plans for tho courso. The questions put to him were touch ing upon hla qualifications for ofTlco and tho motlvo for hla prosecution of Itoberta tho defendant. Thl3 contin ued until halted by the court. A. J. Connett, father to tho missing man, was then calcd. Ho told of hla son leaving tho homo place and of his sudden disappearance. Ho Identified tho skull and Jaw and certain clothing, including Hiobo that ho himself found at the Jenkins farm. Upon croas-examlnation lie was asked regarding tho physical condition and staturo of Ills son. Ho stated that he was tho tallest of all the boys. When asked If ho were of a quarrcl somo deposition ho vociferously ans wered In the negative and told of his son's good nature and habits. Ho stated that tho team which was Bold by Roberts for $250, together with tho wagon and outfit, wero alono worth at least $360; that his son had been of fored $200 for ono of the horses. Ellsh Denuinger of Sutherland was tho last witness called last ovening. Ho testified to tho finding of the sec ond ahoo near tfio river bank at Sutherland and Identified it in co;irt. Tho first witness called thiB morning was J. W. Shahan, secretary of tho state board of pardons. He related Itoberta coming to his office on Aug- ust 4th and tolling how well he was getting along. His nervo Is holding up well for ono ac cused of a crime of so great enormity. On account of tho engagement of tho theatre for tomorrow afternoon and ovening, court will bo removed to the court houso tomorrow morning. Father of Twenty-one Children H. II. Moore, aged soventy-ono years, waa killed by a Union Pacific train at Lexington Sunday. While walking along tho right of way he stepped from behind a moving freight train di rectly into tho path of No, 2 and was struck and almost Instantly killed. Tho aged man was the father of twenty-ono children. Chicago Yards Again Closed Acting upon orders from Washing ton, tho Chicago stock yards wore closed Wednesday night to all ship ments of ltvo stock. Tho embargo will not bo lifted until the yards aro thor oughly disinfected, which It is hoped to havo completed by Monday. Fifteen hundred extra men wero put to work cleaning up tho yards. Discovery of tho foot and mouth dis ease among a shipment of live stock, mostly hogB, to Philadelphia several days ago caused tho federal order. Gerken, plaintiff herein, filed his petition In tho District court of Lincoln County, Nebraska, against said defendants, the object and prayer of which are to quiet the title In the plaintiff ns against the above defend ants impleaded with Others upon the East one-half (EW) of the Southeast quarter (SE'i) and the East one-half (J3H) of the Northeast quarter (NE) of Section thirty-two (32), Township eleven (11), Range twenty-nine (29), Lincoln County, Nebraska, who are claiming an interest In nnd to the abovo described premises by reason of a deed executed by George C. Beneway and wife to Van Brocklin Bros. & Company, composed of William Van Brocklin, J. II. Van Brocklin, Martin Van Brocklin "and Howard G. Thomp son. And aro claiming that whllo said land was conveyed to the grantors ot this plaintiff by said corporation. Van Brocklin Bros. & Company, that tho said William Van Brocklin, Martin Van Brocklin, J. H. Van Brocklin and Howard G. Thompson did not Join in any conveyance, and that their interest in and to said land was never con voyed away. Whereas the plaintiffs al lfgo that said land was conveyed to Van Brocklin Bros. & Company, a cor poration, and that tho said William Van Brocklin, G. H. Thompson and Martin Van Brocklin never had any Interest In and to said land except the interest in said corporation, and that said premises were conveyed by said corporation, and conveyed all the in terest of said parties to tho grantors of this plaintiff. And that said plain tiff has been in tho open notorious and exclusive possession under a claim of tltlo to said promises for tho last ten years prior to the commencement of this suit. And this plaintiff is pray ing for a decree that the above defend ants be excluded from all right, title or interest in nnd to the above described promises.
