Text of German Note.
Berlin, (By Wireless via Sayvlllc,
N. Y.) May fi. Following is tho text
of the note of the German government
in reply to the American note respec
ting submarine warfare, delivered by
Gottlieb von Jagow, the foreign secret
ary, to Ambassador Gerard:
"The undersigned, on behalf of the
Imperial Gorman government has tho
honor to present to his excellency tho
Ambassador of the United States, Mr.
James W. Gerard the following reply
to the note of April 20 regarding tho
conduct of the German submarlno war
fare: Identical With Sussex.
"The German government handed
over to tho proper naval authorities
for early investigation the evidence
concerning the Sussex ns communicat
ed by tho government of the United
States. Judging by the results that
the investigation has hitherto yielded,
the German government is alive to tho
possibility that the ship mentioned
In the note of April 10 as having been
torpedoed by a German submarlno is
actually Identical with tho Sussex.
"The German government begs to
reserve further communication on the
matter until certain points are ascer
tained, which are of decisive impor
tance for establishing the facts of the
case.
"Should it turn out that tho com
mander was wrong in assuming the
vessel to bo a man-of-war, tho German
government will not fail to draw tho
consequence resulting therefrom.
Repudiates U. S. Assertion.
"In connection with tho caso of tho
Sussex, tho government of tho United
States made a series of statements, tho
gist of which is tho assertion that tho
incident is to be considered but ono
Instance of a deliberate method of in
discriminate destruction of vessels of
all sorts, nationalities and destinations
by German submarine commanders.
"The German government must em
phatically repudiato tho assertion. The
Get man government, however, thinks
it of littlo avail to enter into details
in present stage of affairs, moro par
ticularly as the government of the
United States omitted to substantiate
tho assertion by reference to concreto
fucts.
1 Has Imposed Restraint.
"The German government will only
state that It has Imposed far-reaching
restraints upon tho uso of the sub
marine weapon, solely in consideration
of neutrals' interests, in splto of tho
fact that these restrictions are neces
sarily of advantage to Germany's ene
mies. No such consideration has ever
been shown neutrals by Great Britain
and her allies."
"The German submarine forces have
had, in fact, orders to conduct tho sub
marine warfare in accordance with the
general principles of visit and search
and the destruction of merchant ves
sels recognized by International law,
tho solo exception being the conduct
of warfare against enemy trade car
ried on enemy freight ships encoun
tered in the war zone surrounding
Great Britain.
Has Given No Assurances.
"With regard to theso, no asurances
have ever been given to tho govern
ment of the United States. No such
assurances aro contained in tho declar
ation of February 8, 1910.
"Tho German government cannot
admit any doubt that these orders
wore given or executed in good faith.
Errors actually occurred. They can
In no kind be avoided altogether. Al
lowances must bo made in the con
duct of naval warfare against an ene
my resorting fo all kinds of ruses,
whether permissible or Illicit.
Implies Dangers For Neutrals.
"But apart from tho possibility of
errors, naval warfare Just llko war
fare on land, implies unavoidable
dangers for neutral persons and goods

"Tho German government has re
peatedly and oxplicltly pointed out
tho dangers from mines that havo
led to the loss of numerous ships.
U. S. Blamed For "Accidents."
"Tho German government has made
soveral proposals to tho government
of tho United Statos in order to re
duco to a minimum for American trav
elers and goods tho inherent dangors
of naval warfare. Unfortunately, tho
government of tho United States de
cided not to accept tho proposals. Had
it accepted, the government of tho
United States would. have boon instru
mental In preventing tho greater part
of the accidents that American citi
zens have met with in tho meantime.
"Tho German government still stands
by its offer to come to an agreement
along these lines.
Cannot Dispense With U-Boats.
-"As the German government repeat
edly declared, it cannot dispense with
the uso of tho submarlno weapon in
the conduct of warfare against ene
my trade. The German government,
however, has now decided to make a
further concession, adapting methods
of submarine war to the interests of
neutrals.
"In reaching this decision tho Ger
man government is actuated by con
siderations which aro above the level
of the"'uisputed question.
Helped Develop Laws.
"Tho German government attaches
no less Importance to the sacred prin
ciples of humanity than the govern
ment of tho United States. It again
fully takes into account that both
Governments for many years co-op-orated
in developing international law
in conformity with theso principles,
tho ultimate object of which has al
ways been to confino warfare on sea
and land to armed forces of belliger
ents and safeguard, as far as possible
noncombatants against tho liorrdra
of war. But although theso consid
erations are of great weight, they
alono would not, under present circum
stances, havo determined the attitude
of tho German government.
Blames British Government.
"For in answer to tho appeal by tho
government of tho United States on
bolnlf of tho sacred principles of hu
man ty and international law, tho Ger
man government must repeat onco
more, will all emphasis, that It was
not the German but tho British gov
ernment which ignored all accepted
rules of International law and ex
tended this terrible war to tho lives
and property of noncombatants, hav
ing no regard whatever for tho in
terests and rights of neutrals and
noncombatants that through this meth
od of warfare havo been severely in
jured. "In selfdcfense against tho illegal
conduct of British warfare while fight
ing a bitter struggle for national exist
ence, Germany had to resort to tho
hard but effective weapon of submar
ine warfare..
Alleges Discrimination.
"As matters stand, the German gov
ernment cannot but reiterate regret
that the sentiments of humanity,
which the government of tho United
States extend with such fervor to tho
unhappy victims of submarine warfare,
are not extonded with the samo warm-
tn or reeling to many minions or wo
mon nnd children who, according to
tho avowed intention of tho British
government, shall bo starved, and who,
by sufferings, shall force tho victorious
armies of the Centrnl Powers into ig
nomlnous capitulation. Tho German
government, In agreement with tho
Gorman people falls to undorBtand
this discrimination nil tho moro as it
has repeatodly and explicitly declared
Itself ready to uso tho submarlno wea
pon in strict conformity with the rules
of international laws as recognized
before the outbreak" of tho war, if
Great Britain likewise was rondy to
adopt tho conduct of warfare to these
rules.
U. S. Attempts Failed.
"Several attempts made by tho gov
ernment of tho United States to pre
vail upon tho British government to
act accordingly failed because of a
flat refusal on the part of tho British
government. Morovover, Great Brit
ain again and ugain has violated in-

Power to Confine War.
"Tho German people know that tho
government of tho United States has
tho power to confino tho wnr to
armed forces of tho belligerent coun
tries in the interest of hunmnnlty and
maintenance of international law. Tho
government of tho United States
would havo been certain of attaining
this end had it been determined to
Insist against Groat Britain on tho In
controvertible rights to freedom of tho
seas.
"But as matters stand tho German
peoplo Is under tho impression that
tho government of tho United States,
while demanding that Germany, strug
gling for existence, shall restrain tho
uso of an effective weapon, nnd while
making compliance with theso de
mands a condition for malntennnco of
relations with Germany, confines itself
to protests against illegal methods
adopted by Germany's enemies. More
over, the Gcrmnn peoplo know to what
considerable extent its enemies aro
supplied with all kinds of wnr mater
ial from the United Stntes.
Guided By Friendship.
"It will Uicrefore, bo understood
that tho appeal made by tho govern
ment of the United States to senti
ments of humanity nnd principles of in
ternational law cannot, under tho cir
cumstances, meet the samo hearty re
sponse from tho German peoplo which
such an appeal otherwise always is
certain to find here.
Offered to Make Peace.
"Tho German government, conscious
of Germany's strength, twice within
the last few months announced beforo
tho world to make peace on a basis
safeguarding her many vital Interests,
thus indicating that it is not Ger
many's fault If peace Is still withheld
from the nations of Europe Tho Ger
man government feels all tho moro
Justified in declaring that responsi
bility could not bo borne boforo tho
forum of mankind and in history if,
after 21 months of tho war's duration,
tho submarine question under discus
sion between tho German government
and tho government of tho United
States wero to tako a turn seriously
threatening maintenance of peace be
tween the two nntions.
Prepared to Do Utmost.
"So far as lies witli tho German gov
ernment it wishes to prevent things
from taking such a course, Tho Ger
man government is propnred to do its
utmost to confino operations of tho
war for the rest of its duration to
the fighting forces of tho belligerents,
thereby also Insuring freedom of tho
seas, a principle upon which tho Ger
man government believes, as beforo,
that it is in agreement with tho govern
ment of tho United States.
"Such a demand would bo Incompat
ible with tho character of neutrality
and the Gorman government Is con
vinced thnt tho government of tho
United States docs not think of mak
ing such a demand, knowing that tho
government of tho United States re
peatedly declares that It is determined
to restore the, prlnclplo of freedom of
tho seas, from whatever quarter It has
been violated.
Orders to Naval Forces.
"The German government, guided by
this idea notified the government of
tho United States that German naval
forces have received tho following or
der: "In accordance with the general
principles of visit und search and tho
destruction of merchant vessels recog
nized by international law such ves
sels, both within and without tho area
declared a naval war zono shall, not
bo sunk without warning and without
saving human lives unless tho ship at
tempts to escape or offer resistance.'
"But neutrals cannot expect that Ger
many forced to fight fo" existence shall
for tho sake of neutrnl Interests re
strict the uso of nn effective weapon
if tho enemy is permitted to continue
to apply at will methods of warfaro
violating rulos of international law."
Expects U. S. To Remove Impediments
"Accordingly tho German govern
ment Is confident that In consequence
of now orders issued to tho naval forces
tho government of tho United States
will now also see to it that all Im
pediments aro removed, which may
may have been In tho way of mutual
cooperation tQward tho restoration of
tho freedom of tho seas during tho war
as suggested in the note of July 23,
1015, and it does not doubt that tho
United States will now demand and
insist that tho British ' government
shall forthwith observo tho rules of
International law universally recog
nized beforo tho war as aro laid down
In tho notes presented by tho govern
ment of tho United Statos to tho
British government Dec. 20, 1914, and
Nov. G, 1915."
"Should tho steps taken by tho gov

itself complete liberty of decision,
