District Attorney Rwann soon after that
hour arrived at Vr. "Talte'a apartment
and went In, accompanied by a stenogra
pher. It waa given out that Dr. Walte
had taken tha opiate to Induce aleep and
It waa believed that ha would recover.
District Attorney Bwann, emerging from
Dr. Watte' apartments shortly before I
o'clock, mad thla announcement:
"I ahall charge Dr. Walte with murder
In the first degree.
The district attorney received Informa
tion laat night from Orand Rapid a In
dicating that Peck my have been poi
soned. Dr. Otto M. Shult performed an
autopsy on Peck's body at Orand Rapids,
whara It was aent soon rfter Peck's death
here on March II.

Dr. Walte to the Tomb court for ar
raignment at 1 o'clock.
