Buy Una platted Bay lias' addition to Council Bluffs In 1K3, and at that time tha plat shows that the tract now known aa Bayllas park was dedicated ao a publlo square, being marked on the plat In large letters "P. 8." and In the de scription referred to aa "public square." . Former Halt to Recover. In 173 Samuel 8. Bayllsa brought ault against Pottawattamie county to recover possession of the tract marked on the pint of the addition, as "P. 8.", and the city of Council Bluffs Intervened, claiming to be owner of the property In controversy. On be-half of the city It was claimed that the acknowledgment and recording of tha plat by Bayllsa was In fact and In law equiva lent to a deed In fee simple and that Bay llsa thereby irrevocably passed to the city of Council Bluff the fee simple title thereto, and that Bayllsa hud neither a legal or equitable title thereto. The city further recited the fact that the property had been used.., ever since IKS, the date ot the platting and dedication of the tract, at n publlo park, and as such the city had made extensive Improvements upon It. After several years of litigation the ault waa decided against Bayllsa and the title to tha park held to be In the city.
