The possibilities of tli clly being attain
rallvi upon to defend it title to Bayll
park. the beauty spot In the center of tha
city, are anld to Imminent. Tha visit
here of Samuel P. Rayllss, ion nf Samuel
8. Bayllsa, mho "donated tha park to tht
city and after whom It was named, ta said
to he for tiia purpose of btinlii ault to
recover possession of the property.
It ia atated that Mr. Bayllsa will bring
ault to recover possession Of the property
n tha rrnunda that It waa not devoted to
the purpose for which It waa t I von and In
tended hy hl father. According to Mr.
Baylls the tract now known aa Bayllsa
park wax donated by hla father aa a alta
for the county court houee and not for a
public square. Further, that at the tlma
hla father donated the property it waa ex.
pieasly agreed that If the court house waa
not erected thereon within five years the
land should revert to the donor or his helra.
The general understanding has been that
thfl tract waa donated by Bamucl 8. Bay
Has to the city for a public square or park,
but It is sold that the son has In his pos
session the agreement drawn up at the ttm
the land was donated whereby In the event
of the court house nut being erected theroon
It was to revert to the donor or his helra.
It Is said that Mr. Hay lies before coming
here, this being his first visit to the city
in twenty-seven years, secured the advice
of eminent cotinael In New York City and
that they aaaurtd him his claim was Indis
putable. The records In the county court house
show that Siimuel 8. Buy Una platted Bay
lias' addition to Council Bluffs In 1K3, and
at that time tha plat shows that the tract
now known aa Bayllas park was dedicated
ao a publlo square, being marked on the
plat In large letters "P. 8." and In the de
scription referred to aa "public square." .
Former Halt to Recover.
In 173 Samuel 8. Bayllsa brought ault
against Pottawattamie county to recover
possession of the tract marked on the pint
of the addition, as "P. 8.", and the city of
Council Bluffs Intervened, claiming to be
owner of the property In controversy. On
be-half of the city It was claimed that the
acknowledgment and recording of tha plat
by Bayllsa was In fact and In law equiva
lent to a deed In fee simple and that Bay
llsa thereby irrevocably passed to the city
of Council Bluff the fee simple title
thereto, and that Bayllsa hud neither a
legal or equitable title thereto. The city
further recited the fact that the property
had been used.., ever since IKS, the date ot
the platting and dedication of the tract, at
n publlo park, and as such the city had
made extensive Improvements upon It.
After several years of litigation the ault
waa decided against Bayllsa and the title
to tha park held to be In the city. The rec
ords In the court house show that Mrs.
Martha Bayllas, widow of Samuel Bnyllm,
as a result of the suit was called upon U
