and H. O. Devries, Cadet Taylor, D. T.

pany on the 850,000 bond given by the latter
to secure the payment of claims against
tha Insolvent Globe Savings bank. In tha
trial of the case in the district court ths
defendants claimed that as the bond was
to the state of Nebraska only the stats
could rue on It, also that ths assets cf ths
bank had i.ever been turned over to tha
defendants so the conditions of tha bond
wsra not fulfilled; and several purely tech
nical points were also brought forward.
All these tha supreme court sumrrsrlly
brushed aside In Its opinion, In which a
number of authorities are quoted. '
