of Oiiinhn,
lu tlio oplnlou of City Attorney W. J. Cou
ncil women who dcslro to voto for members
of tho Board of Education at tho comlue
election need not register. In fact, Mr. Cou
ncil holds that women cannot register lo
gatly In a city of tho metropolitan' class be
cause tho sections of tho codo which set
forth. tho school laws for metropolitan cities
provl'do that women uro entitled to a voto
for members o;' tho Hoard ot Education alter
swearing that they aro 21 years of ago, that
they havo been In tho district forty days
and that they cither pay taxes or have chil
dren of school ugc. Tho law specifically
states that women shall voto only for mem
bers ot tho school board and Mr. Council
says that they cannot bo permitted to vot
on tho High school bond proposition to ba
submitted nt tho coming election.
Contusion concerning tho registration ot
women as brought about by an amendment
to Bcctlon No. 4 under subdivision No. 2 ot
tho school laws of Nebraska. This section
applies, In tho opinion ot tho city attorney,
to school districts other than thosa In met
ropolitan cities. Tho amendment Is as tot
lows: "All electors In school elections la
cities whero registration ot voters Is re
quired shall comply with tho provisions of
such registration law beforo thoy shall bo
entitled to vote."
Although Mr. Council admits that tbo
author of this amendment may havo In-
tonded that It should rcquiro tho registra
tion of women voters lu Omaha ho says that
it docs not apply to Omaha becauso It Is hot
Included under tho subdivision prepared es
pecially for tho regulation of school clec
tlons In cities ot moro than 100,000 popula
tion. At tho last school election this samo ques-
Hon wna In dlsputo and there were many
nrgumcnts presented on both sides. The re
sult ut tho agitation was that all women who
wero entitled to a voto exercised tho fran
chise regardless of registration. Mr. Cou
ncil cxprctsod at that tlmo tho s.tmo opinion
which ho holds now nnd snys that many at
torneys who formerly contoudod for tho reg
istration of wonion now accept his Interpre
tation of tho law and ngrco that tho amend
ment was not made to tho right subdivision
ot tho school law to bo ctfccUvo In Omaha.
