They refused to pay , saying that the boy who should have pnld for the game had left the saloon. While the thrco were disputing Vance walked around the pool table and when ho arrived In front of Cum mlngs lie had a billiard cue In his hand. Cummlngs swore that Vance Mid that he. would fix him , cr words to that effect , and applied a vulgar epithet to him. Ho then raised n billiard rue and struck at Cummlngs. Cummlugs dodged and looped to escape the blow , and nn lie did FO he picked up a bil liard cue. Hefore Vance had tinio to strike another blow Cuminlngs hit him and he fall to the floor. This portion of the testimony contradicted some of Cummlngs' wltnesse. who eiworo that both Vance nnd Cummlngs had cues In their hands and struck at the same time. In the course of Cummlngs * testimony his attorney asked Mm what intent he had In mind when he struck at Vnnee. This ques tion was strongly objected to by tlie prose cuting attorney nnd the objection was sus tained by the court. Cummlngs. however- was permuted to say whether no fearou in jury nt the hands of Vance , and he atisroered that he did. The first question , however , lawyers pay , raises n point that has never been raised in the district court of this dis trict , nnd.
