to convene npaln at 2 o'clock In the after
noon , when tla arsuments to the jury were
begun.
The morning wag occupied by Ihf defense
In Introducing testimony which tended to
show that the prisoner killed Vance In f : lf-
defense. There wer < ! a number of witnesses
on tlie stand nnd thcsv In the main cor
roborated the testimony of othr witnesses
for the defense. There was fcome contradic
tion In Riving Hie details of the affair and
It was understood that the state's attorney
would devote n portion of his remarks to tin-
jury to attempting to show that therefore
their testimony should not be held as being
credible.
Tlio only matter In the trial yesterday
which tended to arouse any Interest In the
case was the fact that Cummlngs was to bo
placed on the stand. Ills testimony , how
ever , failed to develop anything now. as It
was In line with that given by tli ? witnesses
for his defense. It differed In many re
spects , though , front that given by the state's
witnesses.
CununliiRs said that after the first pool game ,
which had not been settled for and after ho
had made n demand for money , two ot the
boys who had been In the game spoke thro.it-
enlimly lo him. They refused to pay , saying
that the boy who should have pnld for the
game had left the saloon. While the thrco
were disputing Vance walked around the pool
table and when ho arrived In front of Cum
mlngs lie had a billiard cue In his hand.
Cummlngs swore that Vance Mid that he.
would fix him , cr words to that effect , and
applied a vulgar epithet to him. Ho then
raised n billiard rue and struck at Cummlngs.
Cummlugs dodged and looped to escape the
blow , and nn lie did FO he picked up a bil
liard cue. Hefore Vance had tinio to strike
another blow Cuminlngs hit him and he fall
to the floor. This portion of the testimony
contradicted some of Cummlngs' wltnesse.
who eiworo that both Vance nnd Cummlngs
had cues In their hands and struck at the
same time.
In the course of Cummlngs * testimony his
attorney asked Mm what intent he had In
mind when he struck at Vnnee. This ques
tion was strongly objected to by tlie prose
cuting attorney nnd the objection was sus
tained by the court. Cummlngs. however-
was permuted to say whether no fearou in
jury nt the hands of Vance , and he atisroered
that he did. The first question , however ,
lawyers pay , raises n point that has never
been raised in the district court of this dis
trict , nnd. If Cunimlngs Is convicted , will
probably bo made the chief grounds on which
the case will be carried to the supreme court.
When the defense rested the fctate intro
duced ns evidence come of the testimony given
by wltnissca for the defense In police court ,
which , It is held , contradicts tuelr testi
