Behind this suit there Is < | ulto a little
story of how Moody got fleeced out of the
money while on a visit to Denver , and after
losing tlio money ho stopped the payment of
the check. From allldavlts In the case It
seems that some tlmo ago Mr. MooJy visited
Denver , nnd In the course of hU wanderings
around the city , stopped Into "Soapy"
Smith's place on Market street. This place
Is conducted as a cigar store , but In the
rear of the store there la n small green
covered table over which many of the hang
ers on whllo away their time In ascertain
ing the value of four aces and full houses.
This Is what they were doing when Moody
dropped In. Ho wanted to be sociable , and
after Inquiring the limit of the stakes and
the ante ho pulled out a wad of green
backs nnd took a hard In the game of poker.
Ho met with varying success for a time ,
until dually he diew four queens. Ho was
Eiira that this was n winning hand , and he
determined to spring a coup on the moun
taineers. Ho would just give them a touch
of high life , so to speak. Ho didn't have
money enough to play ns high as ho wanted
to , and offered thecheck. . None of the
players would cash the piece of paper , but
finally Smith did so , and Mr. Moody bet
the whole amount on the hand. When It
came to n show down It was found that one
of his opponents held four aces , and ho
scooped In the big pot , whl o Moody didn't
have money enough to buy a night's lodg-
ItR. Ho protested that the game was not
on the square , but to no purpose. Tlio check
\\as turned over to Mr. Meyer , who tent It
to Soutli Omaha for collection , but before It
was paid Mr. Mnody protested against pay
ment , and now iuc/or Is trying to bring the
aid of the courts to his assistance to recover
the cash. In his own behalf , Moody alleges
thai ho Is not a gambler , nnd Is unused to
the dark ways of running up a cold dock.
In the afternoon Moody's nttorrey present
ed an nllldnvlt fiom the defendant to the
effect that ho had been drugged In one cf
the saloons near Smith's place and did not
know anything from " until G o'clock on that
day. Ho Is of the firm belief that some of
Smith's gang spotted him as \lctlin on his
arrival In the city , and arranged matters so
that ho was drugged and then they robbed
him of the check. Ho denied signing or giv
ing the check to any one for any purpose
whatever. Ho alleges that the check must
have been stolen from him wlillo ho was In
a dazed condition. Expert testimony was
given to show that there was considerable
resemblance In different slg atures made by
Moody and the one endorsing the check
which was the subject of controversy.
Judge Baxter held that the cheek had not
boon feigned by Moody and that the phlntlff
had not fully established Moody's Identity
as the man who ga\e the check to Smith.
He also held that Moody was entitled to the
money which the check calls for , and ho
dismissed the cases , against the Stock
Yaids bank and ths Nebraska Live Stock
Commission company. He will retain the
money In his possession for some tlmo yet ,
ns the plaintiffs gave notice that they would
fllo a motion for a new trial.

Frank Baker Is a well-to-do farmer living
near I'ender , Neb. He conducts his farm on
money making principles , and until recently
had a husky hired man'In his employ. One
day last week Dakar knocked oft from work
for a fe.v days , and with his \vlfu , went to
visit some friends , leaving the hired man In
charge of everything. The hired man Im
proved the opportunity , caused by the ab
sence of his emiVjyer , to largely lncic ! > o his
bank account. He loaded up a bunch of
fine , fat hogs and took them to Wlnslde ,
where he so'd ' them at a good figure. Then
ho went back nnd stofu about everything of
moveable value In the house , packed all In
a box and shipped them to Omaha. Ho came
down after them ThursJay night , but in some
manner he had received a "hunch" tunt an
olllccr was on the lookout for the claimant of
the goods. Constable Allen was at the depot
with a writ of replevin , and n warrant for
the arrest of the hired man , but his bird
was too wary , and failed to fchow up , so he
had to take the poods and let the tnicf get
away. The hogs were located In the South
Omaha stock yards , where they were ra-
plevlned by Mr. Baiter before they could
find their way Into Mr. Cudahy's big packing
house and be made up Into sausage and
hams.
