ORDINANCE NO. 301 AN ORDINANCE FINDING, AS CEKTAiNiNG, DETERMINING, L QU ALiZiNG, AND FIXING THE BENEFITS TO AND LEVYING SPE CIAL ASSESSMENTS UPON THE ;:EAL ESTATE, LOTS, PA UTS OF LOTS, AND PIECES OF LAND IN PAVING DISTRICT NO. 0 IN THE CITY OF ALLIANCE, NEBRASKA, TO PAY FOR A PORTION OF THE ;OST OF PAVING, CURBING, 1 AND OTHERWISE IMPROVING THE STREETS AND ALLEYS IN AID DISTRICT. Whereas, the streets and alleys in Paving District No. o in tlu City of Alliance, Nebraska, have b en paved curbed, guttered, and otherwise im proved in accordance with procedure provided by law, and, Whereas, special benefits accrue to property in the district abutting upon and adjacent to the said paved and improved streets and alleys which are as follows, to-wit: Box Butte Avenue, Eighth street to Ninth street. Whereas the total cost of said work is found to be $3,790.56. BE IT ORDAINED by the Mayor and City Council of the City of Alli ance, Nebraska: Sec. 1. That this council meeting as a Board of Equalization for this purpose, after due notice as by law provided, and after due consideration of all facts, find, determine, and fix the total special benefits in Paving District No. 6, resulting from paving, curbing, and other improvements, to be equal to the cost of paving and otherwise improving the portion of the streets and alleys opposite the private property in said district, which cost is $3,7!)0.50; that the special as sessments shall not exceed the cost of the improvement; that the real estate in each quarter Mock subject to the special assessments on account of said improvements is ppecially benefitted by the said improvements in an amount eoual to the whole cost of the improvement of one-half of the street on its front; that the first one sixth in each quarter block next the street or alley paved is specially bene fitted in an amount equal to 33 1-3 per cent of such cost; that the sec ond one-sixth is specially benefitted in an amount equal to 20 per cent of such cost; that the third one-sixth is specially benefitted in an amount equal to 1G 2-3 per cent of such cost; that the fourth, fifth and sixth one sixths are each specially benefitted in an amount equal to 10 per cent of such cost; and further find, determine, equalize and fix the special benefits to, and in pursuance of such action and conclusion hereby levy special as sessments upon the real estate, lots, parcels and pieces of land included in said district as follows, the legal de scription of the property being to the left, and the amount levied against each piece of property being to the right of the legal description of the property, as follows, to-wit: Second addition subdivision, block 8, lot 6, assessment $315.88. Inasmuch as the amounts assessed Inclu.lc interest at seven per cent per annum on the cost of the work for ;he period ending fifty days from this d:.te and also include an amount for commissions and collection charges equal to seven per cent of the totai assessments, on all of said in stallments, except the first, interest shall be collected at the rate of seven per cent per annum from fifty days after this date until each becomes de linquent and on all of said install ments interest shall be collected at the rafe of ten per cent per annum from the .time each becomes delin quent until collected and paid: Pro vided, however, that the owners of any such property may pay the whole amount assessed against such prop erty within fifty days from this date without interest and thereupon, and from the date of such payments, such property shall be exempt from the lien of this assessment and from any lien or charge for the cost of paving, curb ing, guttering, and otherwise improv ing the streets and alleys aforesaid: Provided further that all assessments completely paid anil all installments of any assessments completely paid before the expiration of fifty days from this date shall be reduced by eliminating from such assessments or such installments of such assessments, seven per cent thereof and in addition by deducting from the rem.-.'nder the interest upon such remainder from this date to a date fifty days from this date at seven per cent per an num. Sec. 3. Said speci.il assessments shall be due and payable to the City Treasurer thirty days from this date and at the time of the next certifica tion for general revenue purposes to the County Clerk of Box Butte Coun ty, Nebraska, if not previously paid, said special assessment shall be cer tified to the County Clerk of Box Butte County,. Nebraska, and by him be placed upon the tax list and be collected by the County Treasurer as other real estate taxes are collected and shall be paid over by him to the City Treasurer. Sec. 4. Said special assessments shall be due and payable to the City Treasurer thirty days from this date and at the time of the next certifica tion for general revenue purpose to the County Clerk of Box Butte Coun ty, Nebraska, if not previously paid said special assessments shall be cer tified to the County Clerk of Box Butte County, Nebraska, and by him placed upon the tax list and be col lected as other real estate taxes are collected, and shall be paid over by him to the City Treasurer.
