That every building or other structure, kept, used, main tained, advertised, or held out to tho public to be a place where meals and lunches are served without sleeping accommodations, together with all outbuildings In connection therewith, shall for the purpose of this act, be defined to be a restau rant, and upon proper application to the Hotel Commission shall Issue to such above described business a certificate of registration for a res taurant. Provided, that nothing In this act shall be construed to pre vent the use of any name the pro prietor of a registered restaurant may desire to apply to his businesa, which name does not include the words Hotel, Rooming House or Apartment House. Sec. 7. That on or before July 1st, 1913, and each year thereafter, every person, firm or corporation now engaged in the business of con ducting a hotel or restaurant, or both, or a rooming house or apart ment houee, and every person, firm or corporation who shall hereafter engage in conducting such business, shall procure a certificate of regis tration for each Hotel, Rooming House, Apartment House or Restau rant., so conducted tir proposed to be conducted, provided that one cer tificate shall be sufficient for each combined Hotel and Restaurant where both are conducted in the same building, and under the same management. Each certificate of registration nhall expire on the 30th day of June, next following its issu ance. No Hotel, Rooming House, Apart ment House or Restaurant shall be maintained and conducted In this state after the taking effect of this iiK-t without a certificate of registra tion shall be transferable. Sec. S. The fee for a certificate Deafness Cannot Be Cured by local applications, as they cannot reach the diseased portion of the ear. There is only one way to cure deafness, and that is by constitution al remedies. Defa'iess Is caused by an Inflamed condition of the mucous lining of the Eustachian Tube. When this tube is inflamed yau have a rumbling sound or imperfect hear ing, and when It is entirely closed, deafness Is the result, and unless the inflammation can bo taken out and this tube restored to its normal condition, hearing will be destroyed forever; nine cases out of ten are caused by Catarrh, which ia nothing but an lnflammed condition of the mucous surfaces. Provided further that the annual ex pense of the Commission shall not exceed the registration fees collect ed by the Hotel Commission. Sec. 9. The Deputy Hotel Coni missoner shall,- upon request there for, furnish to any person, firm, or corporation desiring to :onduct a hotel, rooming house, apartment house or restaurant, the necessary application blank for the certificate of registration, which the applicant shall fill in, stating the full name and address of the owner and agent of the building, or both, the lessee and manager of such hotel, rooming house, apartment house or restau rant, together with a full descrip tion of the building and property to be used or proposed to be used for such business, and stating the loca tion of same, which application, up on its return to the Deputy Hotel Commissioner, shall be accompanied by the registration fee of Two Dol lars. Sec. 10. It. is hereby made the duty of the Deputy Hotel Commis sioner to inspect, or cause to bo in spected, at least once annually, ev ery hotel, rooming house, apartment house and restaurant, in the state. and for that purKse he shall have the right of entry and access there to, at any reasonable time. When ever upon such Inspection it shall be found that such businens and property so inspected is not being conducted, or is not equipped in the manner and condition required by the. provisions of this act, It shall thereupon be the duty of the Deputy Hotel Commissioner to noti fy the owner, proprietor or agent in charge of such business, or the owner or agent of the building so occupied, of such change or altera tions as may be necessary to effect a complete compliance with the pro visions of this act. It shall 'here upon be the duty of such proprietor, or agent in charge of 3uch busi ness, to make such alteration! or changes as may be necessary to put such building and premises In a condition that will fully comply with the requirements of this act. Pro vided, however, that thirty days' time after receipt cf such notice shall be allowed for conforming to the requirements of Sections 20. 21, 22. 23 of this act, and sixty days' time for conforming to the require ments of Sections 12, 13, 11, 15, C, 17, 18, 19. Provided fjriher. that the proprietor or managing agent in charge of such business shall not be required to comply with the require ments of Sections 12, 13. 11. 15. 16, 17, 18, 19, whenever the notice here in provided for, and criminal proc ess can be served upon tho owner of the building occupied by such busi ness who in such case, shall be re sponsible for the performance of the lequirements of such sections. Sec. 11. Every person, firm, or corporation, who shall fail or refuse to comply with the provisions of this act, shall be dieemed guilty of a misdemeanor and shall be subject to a fine of f5.00 for each and ev ery day he shall fail or refuse to ao comply. If for thirty days after any final conviction, or any audi viola tion, he or they still fail or refuse to comply with said sections men tioned in auch notice, 'ho building and premises involved may be clos et!
