NOTICE IS HEREBY GIVEN, THAT
by virtue of an order of sale Issued by
the clerk of the district court of the
Third Judicial district of Nebraska,
within and for Lancaster county, in an
action wherein Frank H. Woods, as ad
ministrator, with the will annexed, of
the estate of Arthur B. Gilman, de
ceased, is plaintiff, and Zacharlah
Hammel, et al., are defendants.
I will, at 2 o'clock p. m.. on the 7th
day of January, A. D., 1896, at the east
door of the court house. In the city of
Lincoln, Lancaster County, Nebraska,
offer for sale at public auction the fol
lowing described real estate, to-wlt:
Lots numbered five (5) and six (6) in
block numbered three (3) of Lincoln
Heights, an addition to the city of
Lincoln, according' to the recorded plat
thereof, situated in Lincoln, Lancaster
county. Nebraska.

The Davis and Rankin Building and
Manufacturing Co, defendant will take
notice that on the 'Jbthdayor Nov 1895,
Una Gault plaintiff herein filed his pe-
tition in the county court of Lancas-
ter county Nebraska, the object and
prayer of which was to recover iudg.
ment against said defendant for the
sum of $411.88, and interest thereon at
Beren per cent per annum from the 1st
of September 1895. That an order of
attachment has been issued in said
action and the following property has
been attached thereunder as the pro
perty of said defendant to wit. Three
promissory notes payable to said de
fendant or order as follows. One for
tl00.00 signed by Davis Bros. One for
f 100 00 signed by H. C. Blanchard. One
for t50.00 signed by James Douglas,
Also one hand cream separator received
from the custody of I. W. Channel!,
garnishee in said action. You are re-
quired to answer said petition on or
before Monday January 6th 1893.

Savings bank, a corporation, defend

that on the 5th day of September, 1895,
Isaac Lang, plaintiff, herein filed his
petition In the District Court of Lan
caster County. Nebraska, against said
defendants and others, the object and
prayer of which are to foreclose a cer
tain mortgage executed by the defend
ants, Thomas J. Marshall and Emma
Marshall, to the Clark & Leonard In
vestment Company, and which mort
gage was afterwards and on the 11th
day of November, 1890, assigned to this
plaintiff and which mortgage Is upon
lot ten (10), in block five (5), Ridgeway
an addition to the City of Lincoln, said
county and state, and was given to se
aue the payment of one certain prom-
iasonr note or bond dated T.lnmln TJ a-
braska. Aiurust 29th. 1890. for the mm
of $1000, and due and payable on the
1st day of September. 1895.
That there is now due upon said note
or bond and mortgage the sum of $1,090,
together with Interest thereon at the
rate of ten per ceut per annum from
the first, day of March, 1895.
Plaintiff prays for a decree that th
defendants be required to pay the same

a receiver be appointed to take charge

NOTICE OF FORECLOSURE OF
chattel mortgage by sale of the Mort
gaged Property.
Whereas, on the 14th day of Novem
ber, 1895, C. H. Rohman & Company ex
ecuted and delivered to Elizabeth Mc
Googan a certain chattel mortgage ana
which mortgage was on the 15th day of
November, 1895, duly filed of record in
the county clerk's office, Lancaster
county, Nebraska, to secure the pay
ment of a promissory note executed
at Creston, Iowa, on the 1st day of
March, 1893, for the sum of $2800, due
on demand with interest at the rate of
seven per cent per annum from date
and signed by the said C. H. Rohman &
Company to the said Elizabeth Me
Googan being still the owner and hold
er of said note and demand thereof hav
ing been made and payment refused,
and default having been made, and
there being now due and owing on
said note from the said C. H. Rohman &
Co., to the said Elizabeth McGoogan,
the sum of $2800, together with interest
thereon at seven per cent, per annum
from the 1st day of September, 1895, and
by said chattel mortgage said C. H.
Rohman & Co., thereby conveying to
Elizabeth Mcuoogan all the goods,
wares, merchandise, office furniture,
fixtures, show cases, cheese case, coffee
mill, refrigerator and all personal prop-
erty now in and upon the west one-
half side of the store room and base
ment lately occupied by said Rohman
& Co., at No. 1032 O street lnthe city
of Lincoln, Nebraska, together with
one gray horse, age about 11 years,
called Frank; one dun pony age seven
years called Topsy; one chestnut pony
eight years old called Bell; one set dou
ble harness; one set single harness; one
large delivery wagon; one cart; also
one half Of all bOOks Of account as
shown by said firm books. All of which
property we will offer at public sale at
the hour of ten a. m. at the store room
aforesaid on the 5th day of December.

pursuant to coupons.
Plaintiff prays for decree of fore-
