vs. Thomas J. Marshall, et aL, defend
ants. To Thomas J. Marshall and Emma
Marshall, Louis 8. Marshall and Mrs.
Marshall, his wife, whose first
real name Is unknown, and the People's
Savings bank, a corporation, defend
ant. Tou and each of you will take notice
that on the 5th day of Septemer, 185,
Isaac Lang, plaintiff, herein filed his
petition In the District Court of Lan
caster County, Nebraska, against said
defendants and others, the object and
prayer of which are to foreclose a cer
tain mortgage executed by the defend
ants, Thomas J. Marshall and Emma
Marshall, to the Clark & Leonard In
vestment Company, and which mort
gage was afterwards and on the 11th
day of November. 1890, assigned to this
plaintiff and which mortgage Is upon
lot ten (10), in block five, (5). Ridge way
an addition to the City of Lincoln, said
county and state, and was given to se
cure the payment of one certain prom
issory note or bond dated Lincoln, Ne
braska, August 29th, 1890, for the sum
of $1,090, and due and payable on the
1st day of September, 1895.
That there is now due upon said note
or bond and mortgage the sum of $1,009,
together with interest thereon at the
rate of ten per cent per annum from
the first day of March, 1695.
Plaintiff prays for a decree that the
defendants be required to pay the same
and that said premises may be sold to
satisfy the amount found due and that
a receiver be appointed to take charge
of the property and for general relief.
Tou are required to answer said pe
tition on or before the 18th day of No

company Is plaintiff and Theodore Kaar
Is defendant, and one In an action
wherein Western Glass & Paint compa
ny Is plaintiff and Theodore Kaar and
Mrs. Sarah Kaar are defendants, I will,
at 2 o'clock p. m., on the 17th day of
December. A. D 1895, at the east
door of the court house. In the city of
Lincoln, Lancaster county, Nebraska,
offer for sale at public auction the fol
lowing described real estate to wit:
The north half of the southeast quar
ter of section thirty-three (33) township
nine (9) north, range six (6) east of the
6th P. M., in Lancaster county, Ne

You are hereby notified that an in
strument perporting to be the last will
and testament of A. C. Murphy, deceas
ed. Is on file In said court, and also a pe
tition praying for the probate of said
instrument, and for the appointment
of Mary L Murphy as administratrix,
C. T. A.; that on the 7th day of Decem
ber. 1895. at 9 o'clock a. m., said peti
tion and the proof of the execution of
said Instrument will be heard, and that
if you do not then appear and contest,
said court may probate and record the
same, and grant administration of the
estate to Mary I. Murphy.

CHATTEL MORTGAGE BY SALE OF
THE MORTGAGED PROPERTY.
Whereas, on the 14th day of Novem
ber. 1895, C. H. Rohman & Company ex
ecuted and delivered to Lederer &
Strauss a certain chattel mortgage and
which mortgage was on the 15th day of
November, 1895, duly filed of record in
the county clerk's office of Lancaster
county, Nebraska, to secure the pay
ment of a promissory note executed at
Lincoln. Nebraska, on the 15th day of
July, 1893, for the sum of $2,500, due in
one year after date, payable to the or
der of W. C Stark, with seven per cent
Interest per annum from date and sign
ed by C. H. Rohman & Company and
duly Indorsed by said W. C. Stark to
one Nelson C Brock, and by Nelson C.
Brock indorsed, sold and delivered to
Lederer & Strauss, who are now the
owners and holders of said note, and
default having been made In the pay
ment of the same and there being now
due and owing on said note from said
C H. Rohman & Company to said Led
erer & Strauss the sum of $2,500, togeth
er with interest thereon at seven per
cent per annum from July 15, 1895, and
by said chattel mortgage the said C. H.
Rohman & Company thereby conveyed
to Lederer & Strauss all of the goods,
groceries, wares and merchandise, of
fice furniture, fixtures and personal
property now in and upon the east half
and side of the store room and basement
lately occupied by said C. H. Rohman &
Company at No. 1032 O street, in the
city of Lincoln, Lancaster county, Ne
braska, together with one sorrel horse,
age about eight years; one dun mare,
age ten years; one set harness; one de
livery wagon, all kept In barn at No.
1435 L street, in said city of Lincoln;
also one-half of all books of accounts
as shown by the firm books; all of which
property we will offer at public sale at
the hour of eleven o'clock a. m. at the
store room aforesaid on the 5th day
of December. 1895.

Company has been organized for the
purpose of doing business as a cor
poration with the principal place of
transacting its business in Lincoln,
Nebraska. The nature and charac
ter of the business to be transacted
is the wholesale drug business, sell
ing and disposing of all kinds of
drugs at wholesale, and of all kinds
of Roods, wares and merchandise that
usually accompany -the running of a
wholesale drug house, such as paints,
oils, liquors, wines, cigars and other
similar and kindred articles of merch
andise. The amount of capital stock,
which Is all paid up in shares of $109
each is $116,000. The said corporation
commenced doing business on the 11th
day of October, 1895. and is to con
tinue for the period of ten years un
less the affairs of said corporation are
sooner wound up and terminated. The
business of the corporation is to be
conducted by a board of directors to
be elected by the stockholders, such
election to take place at such time
and manner as shall be prescribed by
