You and each of you are hereby notified that
in an action begun by E. H. Pearson, as plain
tiff, against the Badger Lumber Company and
others, as defendants, the Philadelphia Mort
gage a"-d Trust Company, as intervener anil
defendant, filed its answer qnd cross petition
against you and other defendants in the dis- -trict
court of Lancaster county, Nebraska, the
object of which is to foreclose a
certain mortgage on the following land in the
said county, to-wit: All that tract of land in
the northwest quarter of section 23, town 10,
north of range G east of the Cth principal me
ridian, more particularly described as follows,
namely, beginning at a point 438 feet east of
the northeast corner of block number 22 in Lav
ender's addition to Lincoln, for a starting
point, thence east 22 feet, thence south 112 feet,
thence west 22 feet, thence north 112 feet to the
point or place of beginning made by Jane O.
Hutchins and Charles H. Hutcbins to The
Clark & Leonard Investment Company dated
July 3. 1S89, to secure the payment of a promis
sory note of said Jane G, Hutchins and Charles
11. Hutchins to said The Clark & Leonard In
vestment Company for $8,000 on which there is
now due $&S5.22 with interest from July 1, 1891,
at 10 per cent per annum pursuant'to coupons:
also a mortgage on the north half of lot 3 in
block 22 in the city of Lincoln in said county
made by Jane G. Hutchins and Charles H.
Hutchins dated November 30, 1SS9. to secure
the payment of a promissory note of said Jane
O. Hutchins and Charles H, Hutcbins to said
The Clark fc Leonard Investment Company for
$3000 on which there is now duo $8923.06 with
interest from June 1. 1891, at 10 per cent per an
num. Plaintiff and the Philadelphia Mortgage and
Trust Company pray for a decree of foreclosure
and sale of said land to satisfy said liens as
aforesaid, for the appointment of a receiver,
for deficiency judgment and general relief.
You are required to answer plaintiff's peti
tion on or before the 25th day of March, 1895.
