John R. Preston, defendant, will take
notico that on the 12th day of Novem
ber, 1891, plaintiff tiled a petition in the
district court of Lancaster county. Neb
raska, against the above named defen
dants, the object and prayer of which
are that the conveyance of the south
half of the southeast quarter of section
22, town 9, range C, Lancaster County,
Nebra&ka, from Abner G. Preston to
John R. Preston, and the conveyance of
the north half of the southwest quarter
and the south half of the northwest
quarter of section 23, town 9, range G,
Lancaster county, Nebraska, from Ab
ner G. Preston to Ed. P. Urown and
from Ed. P. Brown to Emma Preston be
cancelled and set aside and held for
naught, and that said property free
from encumbranco be declared to be
the property of Abner G. Preston, and
that the same be sold under execution
to satisfy a judgment in favor of said
HoIIis JO. Wood and against said Abner
G. Preston and Charles S. McKenny,
the amount of which is 8230.00 and costs
drawing 10 per cent interest, because
said conveyances are without consider
ation and made for the purpose of de
frauding the plaintiff and other credit
ors You are required to answer said peti
tion on or before tho 18th day of March,
1893.

ment of Elizabeth Dahsen as executrix

& Leonard Investment Company, as
principal, began an action against you
and other defendants in the district
court of Lancaster county. Nebraska,
the object of which is to foreclose the
following mortgages on land in Lancas
ter county, to-wit:
A mortgage on all of b!ock 5 except
lot number 21 inMaplewood Addition to
Lincoln made by James S. Small to
William M. Clark, dated October 12,
1839, to secure the payment of 90 prom
issory notes of said Small to said Clark
for S 13.50 each, on which there is now
due $1361.83 with interest from October
12, 1S90, at the rato of ten per cent per
annum.
A mortgago on tho north half of block
number 7 and all of lots 21, 22, 23 and 24
in block number 6 in Maplewood Addi
tion aforesaid, made bv James S. Small
to William M. Clark, dated October 12,
18S9, to secure )ho payment of 43 prom
issory notes of said Small to said Clark
for 313.50 each, oi which there is now
duo ST51.63 with interest from October
12, 1890, at the rate of ten per cent per
annum.
A mortgage on all of block number
8 in Maplewood Addition aforesaid,
made by James S. Small to William M.
Clark, dated October 12, 1839, to secure
the payment of 99 promissory notos of
said Small to said Clark for the sum of
313.50 each, on which there is now due
31504.93 with interest from October 12,
1890, at the rate of ten per cent per an
num. Plaintiff prays for decree of foreclos
ure and sale of said land to satisfy tho
liens thereon for deficiency judgment
and general relief.
