In the district court of Lancaster county, Ne
braska. To Leander Elliott, Minnie Elliott, Gilbert M.
Barnes, Hattle II. Barnes and Durrell & Leighty.
You are hereby notified that on the 23d day of
March, ISM, De La Green, plaintiff herein, filed his
petition in the district court of Lancaster county,
Nebraska, against Leander Elliott. Minnie Elliott,
James Clisbe, Francis N. Gibson, Jesse Davis,Ben
Turner, Gilbert M. Barnes, Hattie H.Barnes, Dur
rell A Leigbty, Western Investment company, H.
J. Hall A Brother William M. Clark. Nelson C.
Brock, Jesse V. Bell and Annie Bell, defendants,
the object and prayer of which are to foreclose a
certain mortgage executed on the 9th day of
December, 18s9, by Leander Elliott and Minnie
Elliott to the Lombard Investment company on lot
numbered eight 8 in block numbered two 12 in
Muir's addition to J. O. Young's East Lincoln, in
Lancaster county, Nebraska, to secure the payment
of one note for eleven hundred dollars SllUOJ, with
interest at S per cent, payablo annually, according
to the tenor and effect of ten interest coupons
thereto attached, due and payable on the 1st day
of December, 1894, and now ovnM by the plaintiff
therein.
That there is now due and payablo on said note
and mortgage the sum of $1100X0, with interest at
6 per cent per annum from December 1, 1893, and
the further sum of $33.00 with interest at 10 per
cent from December I, 1893, and the
further sum of protest fees, with inter
est at 10 per cent from December 4, 1893. for which
sums with interest as above, the plaintiff prays
judgment for a decree that the defendants Day the
same and that in default of such payment that the
defendants may be foreclosed of all equity of re
demption or other interest in said premises, that
said premises may bo sold to satisfy the amount
found due the plaintiff.
You are required to answer said petition on or
before the 31st day of May. 1894.

the 1st day of September, 1894, and again oa the 1st
day of December, 1894, to examine all claims
against said estate, with a view to their adjust
ment and allowance. The time limited for the pre
sentation of claims against said estate is six

that on March 21, 1894, the Clark fe Leon
ard Investment company and A. H. Sawyer,
as the executor of the last will and testa
ment of Eliza T. Clark, deceased, as plain
tiffs, began an action against you and other
defendants in the district court tf Lan
caster county, Nebraska, the object of which
is to foreclose a certain mortgzgcon the
following land in said county, to-wit: Lots
number 7 and 8 in block 197. in Lincoln, ac
cording to the recorded plat, made by
Maggie Paul, dated June 28, 1888, to secure
the payment of a promissory note of said
Maggie Paul to said the Clark &, Leonard
Investment company for $330, on which
there is now due 2378, with interest from
July 1, 1890, at 10 per cent per annum pur-
ruant to coupons.
Plaintiffs pray for decree of foreclosure
and sale of said land to satisfy said liens as
aforesaid, for deficiency judgment ard gen
eral relief.
You are required to answer plaintiff's pe
tition on or before the 21st day of May 1894.
