Leflang, Omaha capitalist, was granted a divorce from his wife last March in St Jo seph, Mo., after he had been denied a decree in Douglas county, was dis closed to District Judge Sears in i Omaha yesterday, t Norris Brown, attorney for Mrs. yt cflang, presented the evidence be fore Judge Sears. "It's the strangest thing I ever heard of," said Judge Sears. In his petition in the St. Joseph courts, Leflang swore that he had been a resident of Missouri for a year, though he affirmed in his peti tion in the local courts last Novem ber that he had been a resident of Nebraska for many years. . Mrs, Leflang has never been no tified of the petition in St. Joseph. The late petition was filed March 17, 1921. The decree was granted May 6 by. District Judge Allen there. Attorney Brown learned of the fil ing of the petition in St. Joseph through a friend. Iowa Board to Probe Escape From Prison Strief, member of the state board f control, who is in charge of Fort ladison and other state institutions, will leave here tomorrow morning for Fort Madison to start an investi gation of conditions responsible for the escape of Robert Don Carlos, Des Moines bank bandit, and John Stillman, gangster. The board of control has received a number of anonymous leters crit icizing the administration at the pen itentiary, but has paid little attention to them until Wednesday's jail de livery. Nine other men have escaped jfrom. the penitentiary since last Decem ber. . - ... Two Tried for Death Of 'Dry' Officer Freed v r El Paso, June 3. After deliberat ing 28 hours, the jury in the Shear man murde trial acquitted Allen Shearman and Thomas Mendb2a and reported inability to agree in the case of C. Shearman and his sons, NHI and John. The trial was the outcome of the killing on .March 21. of two prohibi tion officers, C. A. Wood and S. E. Beckett, who, with the two other federal . officers, attempted to serve a search warrant on the Shearman ranch five miles east of El Paso. The defense claimed JN officers fired on,C. P. shearman and ."the r aiid his son, jonn, aamittea rned the tirt. France to Preserve Explosive in Huge Ice Water Reservoir Paris, June 3. Approximately 900,000,000 francs worth oi explosives which the French have accumulated since the armistice will be placed in huge ice water reservoirs which will be constructed in the . Alps and Pyrennes. Former Minister of War Andre Lefevre discovered that some of the powders were liable to spontaneous combustion unless preserved under ice-cold water. The construction of the gigantic reservoirs will cost 8,000,000 francs, but will insure France two and a half years' supply of explosives for the next war. The chamber of deputies will vote on the proposition next week. Senate Passes Phone Bill Washington, June 3.- The senate passed a house bill allowing tele phone companies doing interstate business to consolidate with the ap proval of the Interstate Commerce commission. The measure goes to the president. Trusted Employe Held With Others On Theft Charge Byrne-Hammer Man Accused Of Substituting High-Priced Goods in Sales; More Arrests Expected. Three men, one a trusted employe of the Byrne-Hammer Dry Goods company for 25 years, are being held by police in connection with the wholesale thefts of goods from the firm. , , The employe, Edward Rothwell, Twenty-third and California streets, was arrested Thursday night. He is said to have made sales to merchants at .low prices and to have filled the orders himself, substituting higher priced goods, according to police. Max Rosenthal, 240? Indiana ave nue, and C. Colton, 1714 North Twenty-fourth street, merchants, were arrested yesterday and are be ing held without bonds. Their at rest is expected to help solve the mystery surrounding the thefts, said to total more than $10,000, accord ing to police. Arrests of two more merchants, expected within a day, will clear up the robberies, police say they' believe. According to Chief of Police Dempsey, one of the merchants un der arrest was willing to escape prosecution by offering to settle for $3,000. Rival Firm May Take Over . Defunct Quaker City Bank Philadelphia, June 3. After a con ference 'it was announced that the Bank of the Sons of Italy would take over the South Broad Street Trust company, which was forced to sus pend business, provided the agree ment, meets approval of the state banking commission. The South Broad Street Trust company, a small bank dealing largely with Italians, is solvent, its president declared. He attributed ttie suspension to withdrawals by snull depositors. The bank has deposits of $250,000, according to its last stati-mrnr. Re sources were given as $49,000. Naturalization Graft Ring Bared Thousands Said to Have Been Collected From Aliens Seeking Citizenship. Chicago, June 3. Existence of a naturalization graft ring, involving both federal and county officials and said to have garnered thousands of dollars from applicants for naturali zation papers, was revealtd by the arrest of Edward Zappan, former clerk in the office of the clerk of the Cook county circuit court, and the issuance of warrants for the arrest of Herman P. Bartells, chief of the naturalization department of the cir cuit court, and four others. Zappan was arraigned before a United States commission -and re leased on $5,000 bond. Late today the warrant had not been served on Bar tels,. while the identity of the four other men named is being held secret by the Department of Justice. They are said to he men of prominence, "the higher-ups," through whom the bulk of the graft found its Avay. The warrants charge conspiracy and im personation of a federal officer. The plan of operation, according to1 information lodged with the dis trict attorney, was for an agent of the ring to approach applicants for naturalization with the information that there was an affidavit on file in the Cook county court charging an offense that would stop issuance of his naturalization papers. This was followed with an offer to "fix" the court proceeding. The applicant was then taken ts the offices of the clerk of the circuit court and "the affidavit" torn up. He was then told that there would be no objection to granting his papers. The affidavits were "faked" for the purpose of intimidating .the appli cants. Auto and $500 in Silki Stolen From Hamburg, Id.
