THE BEE: OMAHA. THURSDAY, MARCH 3, 1921. Power Company Earnings Too Low, Asserts Expert ' Owners Have Not Received Fair Return on Investment, lie Says Mayor Extends Sympathy. Mayor Smith commiserated inves tors in the property of the Nebraska Tower company, because of the 'pain and suffering" they have ex perienced, lie did this at the hear ing of the electric light and power rate case before the city council yes terday afternoon. The mayor, however, wanted to know whether he should extend his sympathy to the bondholders, own ers of preferred stock or the owners of common stock. He sought this information from W. J. Henderson of New York, expert in the service of the company. Mr. Henderson ex plained that he spoke only in terms of the irtoperty as a whole, rather than for any group or particular class of owners of the property. "I know that these owners have not received a fair return on their investment," testified Mr. Hender son. Fail to Get Fair Return. One of the exhibits offered by the New York man for the information of the mayor and city commission ers showed that during the four-year period ending December 31, 1920, patrons of the company failed to the extent of $3.16,387 to provide a fair return on the. property, to say noth ing of a depreciation reserve fund which Mr. Henderson says was not allowed. This1 was one of the points he made in support of his case, that the company should be allowed in creased revenues by reason of in creased rates. The commissioners and the repre- sentati.ves of the company considered at length the subject of the liability of patrons in keeping the plant up to 100 per cent condition new, and the liabitity of investors in providing money for replacements installed at a cost greater than that of the original units. "It is the opinion of experts gen erally," said Mr. Henderson,, "that properties settle down to a condi tion of approximately 80 to 85 per cent of newness. Commissioner Ure asked Hender son to suppose a case of a unit costing $127,000 being replaced by a' unit which cost $247,000, and then asked this question: "Wouldn't you say that the money to pay the difference should come out of the pants pockets of the investors?" Mr. Henderson replied that the money might come from one of several sources, adding: "The own ers are entitled toi a return on a fair valuation of their property and a sufficient reserve fund to keep the plant to 100 per cent condi tion.' "Why wouldn't it be reasonable and best to consider costs as the best measure of fair value?" asked Corporation Counsel Lambert. "Prices don't go up or down; it is the dollar that becomes more or less valuable. It is the purchasing nnu'fr rf thft dollar." the New York man replied. Mr. Henderson told the council that capital will not flow into in dustries that are discriminated against and he added that the in J vestors always take the risks. With rising costs and., restricted rates, wr. HenTlerson asserted that owners of public utilities have experienced many difficulties during the last few years. The hearing was adjourned to 1 o'clock this afternoon, as some of the city commissioners went to Lincoln to attend a city charter hearing. Engineer at Fort Crook Invents Gopher Trap Frank Phillips has been govern ment engineer at Fort Crook for 29 years. For 18 years of that time he has been working on an invention. He finally has completed and patented it. The invention is a gopher trap which Thillips says is certain death. He has perfected two models, one quite expensive, the other relatively cheap. The ordinary. gopher trap, Phillips says, is of little value, because it her comes clogged with the dirt in which it must be buried. An army parade ground is a play yard for gophers, and. when Phillips saw how ordinary traps failed to nab them he started out to invent one of his own. Otrfaha packers said Wednesday the shortage would be close to 200,000 tons which would have to be made up by .buying on the open market and shipping from the far north. The expenditure for ice,-they said, would be appalling. Except for a few days in the early winter, no ice was cut on the lakes and rivers - where the packers and other concerns, harvest their ice an nually. ' The packers were able to harvest a small percentage of the ice need ed for snipping purposes. Most of the companies are equipped with ice manufacturing plants, but when warm weather comes all ice manu factured will be needed in the cold storage houses, they say.
