James R. Farney of Kansas City,
in a lawsuit being tried in the dis
trict court of Hamilton county by
Judge E. E. Good, is trying to ob
tain $37,000 from the guaranty fund
of the state of Nebraska on a check
given him by Charles W. Wentz.
Wentz gave him a check for $37,
000 on the American State bank , of
this city in settlement for selling his
farrrt. His Home bank sent it to the
Federal Reserve bank at Omaha and
it was sent direct to this city. Went
was the vice president and mana
ging officer pf the American State,
bank. .
Wentz says he never saw it. The
other officers of the American State
bank say they never saw it. Wentz
left Aurora and it was some days
before he was located. In the mean
time his bank was taken over by
the state authorities and is now in
the hands of a receiver. It is badly
insolvent
The check was sinned bv the W.
C: rentz company of which Wentz
was president and managing offi
cer, its account in the American
State bank was overdrawn about
$25,000.
If Farney convinces the court that
he is entitled to a judgment acrainst
the State Guaranty Fund, he will get
all his money. If he Is just a gen
eral creditor, he will get nothing, h
for the general creditors of the bank

of the large breathing muscle called

Running, therefore, r.ot only
causes an extra strain upon the dia
phragm itself and also moves the
ribs more rapidly, but puts an un
accustomed burden upon the strips
of fiber which connect the two, thus
causing the pain which we calt a
"stitch in the side.".
