THE BEE: OMAHA. TUESDAY, JANUARY 4. 1921. Widow of Man Killed by Fall Gets $13,190.47 Court Rules That Violation of Safety Laws Entitle Woman To More Than Work men's Compensation. A judgment of $13,190.47, entered by District Judge A. C. Troup Mon day, in the case of Mrs. Jennie Mc Cain against the Omaha Cold Stor age company, involves a feature which is of interest to building own ers and contractors generally in this J state. Thomas McCain, deceased hus-' band of the plaintiff, was killed last June while working for the Umaha Steel works on an addition which was being made to the plant of the Omaha Cold Storage company. Mc Cain fell from the top of the third story, which was being added, and struck a steel beam near the roof of the old building. He fell a dis tance of nearly three stories and died within a .few hours. Safety Law Violated. One of the safety laws enacted by the state legislature before the oper ation of the state compensation law provides that in the erectidn of build ings planked flooring must be placed on every other floor at least. If this law had been observed in the case of McCain, it was contended that he probably would have fallen not more than 12 feet and would not have been killed. The widow was allowed working men's compensation of $15 a week for 350 weeks, but she brought 6uit in district court on the grounds that the state' law had not been complied with and that the compcnsatiortal lowance did not cover this alleged law violation. Woman Hat Six Children. The preliminary hearing of the case was before Judge W. A. Redick and Judge Troup entered the judg ment, which was agreed to by plain tiff and defendant. The issue of the case was that building owners and contractors cannot violate the state building protection laws and then be immune under the workingmen's compensation. Mrs. McCain lives in Council Bluffs. She has six children: Twins, J i months old, and the others are 3, 7, 8 and 16 years, respectively. Her case was handled by Anson H. Bige low. "The law under which we brought action holds both the owner and con tractor liable for observance of the state laws pertaining to safety during building construction," said Mr. Digelow. Two pearl necklaces and a war medal secured by the doctor in France were part of the loot Mrs. Mick recalled the visit of the woman book agent several days ago, who acted suspiciously then, she said, ap parently studying the ."lay of the land." f Board Makes Pinal Effort N To Award Paving Contracts By a vote of three democrats to two republicans the county commis sioners yesterday passed a resolu tion asking District Judge Sears to modify the order restraining the awarding of $1,500,000 worth of con tracts for county paving. This move was hailed as a final effort to let the present democratic , board award the contracts before midnight next .Wednesday. The restraining order was granted on petition of various civic organiza . tions, on the theory that much lower bids can be obtained by waiting a few months. Officer in Charge of Radio Work in France Visiting Here Lieut. Col. Ro6ert Loghry, who was in charge of all radio work along the American front in the world war, arrived in Omaha Sun day with his wife to spend three weeks with his wife's parents, Mr. and Mrs. James Johnson, 2111 North Twenty-fourth street. He has just been re tired from the signal service of the United States army and is on his way to ,San Francisco to take a civilian position as radio engineer with the signal corps.
