Thomas Ryan wishes to change
hi residence to Sioux City.
They were married 20 years ago
at St. Augustine, 111., and own their
home at 4W8 North Twenty-fourth
street.
Immediately after having lost a
replevin action brought by his wife
in municipal court, Mr. Ryan said
served with a summons yesterday by
a deputy sheriff, advising him that
his wife had started a divorce action
in district court.
The case, which was heard yester
day by Judge A. K. Baldwin in mu
nicipal court, and the allegations re
lated in Mrs. Ryan's .jetition for di-i
vorce stand on all fours.- '
-Mrs. Ryan testified that on No
vember 1 she went to Russell, Kan.,
for a visit for about 10 days; that
during her absence Mr. Ryan moved
most of the household goods from
their home and placed them in a
local storage house, with intentions
of moving them to Sioux City,
where she declined to go. She
brought a replevin action and re
covered the coods from storage.
In her divorce petition the wife
alleges that for a oeriod of three
years Mr. Ryan has been guilty of
extreme cruelty by striking her ana
usinar abusive language. She asks for
u decree of divorce ana alimony
''he also relates that her husband
ia a railwav mail clerk and earns
$250 per month. '.,

whom he had married a month be
fore he died, and leaving nothing lo

ha, was upheld by County Judge
Crawtord in a decision handed down
yesterday after a heating which took
live days in county court.
The daughters contested the claims
of the wife, alleging undue influ
ence had been exercised over the dy
ing man. He died August 9, 1920,
in a cottajre near Minneapolis. Minn.

The contestants announced that
they will appeal the case to the dis
trict court.
Water Manager Scores
Power Company Pleas
R. B. Howell, general managet of
the municipal water district, severely
scored the pleas of the Nebraska
Power company for increase in elec
tric and power rates in a statement
yesterday.
To offset the need of such an in
crease he recommended in a letter1, to
the Chamber of Commerce the con
sideration of the development of
electric energy through the construc
tion of one of Nebraska's great wa
ter power possibilities at the Onward
Omaha conference last evening'. Un
fortunately it could not be done as
the president, of the electric light
company was on the program, he
said. .
The late Casper E, Yost, chairman
of the board of directors of the Ne
braska Telephone Co., left his en
tire estate, valued at approximately
$500,000. to his only child, Mrs.
Bertha Yost Offut of Omaha.
The will was filed in county court
yesterday. It was signed July 22,
1912. 's
It leaves his property about equal
ly divided between his wife and his
daughter. Mrs. Yost died last Jauu
ary. Mrs. Offutt, the daughter, un
der the law therefore is the sole
heir.
Both Mrs. Yost and Mrs. Offutt
are named as executrices in the will.
Mrs. Offutt applied to act as exe
cutrix yesterday.
The estate consists almost entirely
of gilt-edged stocks, bonds, mort
gages and notes. Among other se
curities in various enterprises it in
cludes 269 shares 'of stock of the
United States National bank of
Omaha, valued at several hundred
dollars per share, and 378 shares
of American Telephone and Tele
graph Co. stock, quoted on the
stock .exchange at par.
Mr. Yost died in Los - Angeles,
Cal., November" 22. Burial was in
Omaha last Saturday.

These articles will be placed on
sale Tuesday, Wednesday and
Thursday of next week and contri
butions from friends of the graduate
nurses also will be received.
Similar bazars will be held from
year to year until there is sufficient
money in the treasury of the club
to build a big clubhouse for Omaha's
graduate nurses.
Man Held as Auto Thief
