AGENT REFUSES
TO TAKE STAND

, tify when Thomas Hall, acting
' chairman of. the State Railway com
mission, attempted to question Wiley
yesterday afternoon,
"The witness is withdrawn from
voluntary appearance until our rights
are regarded," said Mr. Bigelow.
"In asking questions before I have
had a chnnce to ask mine I believe
Commissioner Hall is simply fish
ing for an excuse to conceal evi
dence I want to hring'out."
"We wanted testimony on wltges
paid in Des Moines," explained
Commissioner Hall, "but we didn't
want the entire Des Mjines labor
disnute threshed ont again."
Wiley said Des Moines street car
llie:i were awarded an increase in
wages from 51, 54 and 57 cents to
64, 67 andd 70 cents, but the com
pany there had lrcn unable to pay
the increase as yet. The men are
"guaranteed a payment of the wage
increase, however, he said.
Commissioner Thorne Browne ap
pealed to Wiley to act as a witness,
but Wiley declined on 'lis grounds
he lnd been brought here by the
Omaha local union and was instruct
ed by its representatives not to tes
tify. . I

if necessary," he added.

"We expect to have a schedule of
events which will interest 'Maw,'
and 'Paw' as well as the kiddies,"
said Mr. Jones. "In other cities the
movement to interest grownups in
the public playgrounds has been
successful.
Omaha now has IS supervised
playgrounds, each under the direc
tion of a supervisor.
Walter W. Head Refuses to
Join Skinner Company Board
Walter W. Head, president of the
Omaha National bank, has declined
to become a member of the board

ing Co.
"My reason for declining is that
I have not the time .to devote to
it," Mr. Head said. "I( appreciate
the confidence reposed in me, bqt

on anything more."

After two yars of litigation in fed
eral' court the Farmers Irrigation
district of Scottsbluffs, defendants in
suits filed for nonpayment of cou
pons on bonds amounting to about
$90,000, won a victory before Fed
eral Jude Woodrough, who ruled
for the district
uit was started by a company of
bondholders, including Harry P(ayne
Whitney, B. C.Donham and Cerate
Soap company, all of New York. The
bondholders claim that the coupons
on bonds should 1ear 6 per cent, but
people living in the district refused
to, pay this rate because they de
clared in 1915 a proposition was made
whereby only 4 per cent would be
charged on the n-.oney. Judge
Charge One-Arm Man Bit
Officer Resisting Arrest
Handicapped by having only one
' one arm, Angelo Pclretto defend
ed himself by biting Police Officer
.Barnes three times when Barnes at
tempted to arrest him at Sixteenth
and Farnam streets Friday.
; Pctretto is charged with- having
, slapped a woman who accidentally
' jostled him at Tenth and Douglas
' streets. Barnes, who says he wit
nessed the assault, gave chase and
. caught 'up with Pctretto at Sixteenth
and Farnam streets.
Hundreds of passersby stopped to
see the battle, which ended when
Patrolman Manckbell went to the
assistance of ' his brother officer.
Pctretto was takn to jail.

Woodrough ruled that following the
decree the rate of interest shall be
4 per cent while from January 1,
1918, to date he, he fixed the rate at
6 per cent. s
The irrigation district takes in 60,
000 acres and, according to attor
neys for the plaintiff, the ptople liv
ing therein will save thousands of
dollars by the decision. The govern
ment is to operate the Scottsbluff
district in conjunction with several
other projects in that part of the
state.
The case was before Judge Wood
rough lasXDecember, but no decision
was given.
City Engineer Denies
Imperfect Paving Laid
John A. Bruce, city engineer, de
nies that jinperfect paving is being
laid in Omaha.
Charges of alleged carelessness
in repaving Military avenue from
Forty-eighth to Fifty-second streets
have been made.
"I would be pleased to have the
critic of this paving district come
to my office so I can explain the
matter," Bruce said Friday. He
said the Work was satisfactory with
the exception of two or three small
places which would be reconstructed.
