A startling summing op of irregu larities in the receiving of bids for paving the Lincoln highway was made by John P. Breen yesterday in the closing argument of the suit brought by Jamin B. Root, to stop the Douglas county commissioners and Allied Contractors, Inc., from paving 12 miles of Lincoln highway with Warrenite bitulithic com pound. At the conclusion of the argu ment Judge Sears announced -that he will decide in a day or two whether or not to grant an injunc tion stopping the paving of the county roads with bitulithic com pound. Judge Sears, himself, dwelt upon the point that the Warrenite patent expires May S, 1920. "This work would go on for six or eight months after the patent had expired. The county would be get ting no benefit whatever front the royalty which it would be paying on this patent," said the judge. ! "It has been shown that the cost of producing the mixture is $1.37 a square yard and the Warren Bros, get $2.10 per square yard," said Mr. Breen. "You can figure what the royalty amounts to." The carelessness exhibited in promulgating the specifications was attacked by Mr. Breen. . Breen Charges Fraud. " "Some of these irregularities were what, to my mind, amounted to a . fraud," he declared. "For example, in the specifications of materials to be used in paving these county roads, there was provision for War renite bitulithic paving and also for a 'like' paving. . But when, the printed specifications came along, some time later, lo and beholdl- the section providing for the 'like' pav ing had been eliminated. Another startling fact which was brought out in testimony, and which Mr. Breen emphasized in his argu ment, was that the -Warren Bros, did not file their figures for laying their patented bitulithic paving until two days betore the bids were to be opened. "The specifications provide that Warren Bros, company shall file with the department of public ;vorks an agreement; to furnish to any contractor desiring to bid for the work all the necessary Warren ite bitulithic surface mixtures, mixed ready for use," said Mr. Breen. "The specifications did not state when this agreement had to be filed. And the evidence shows that it was not filed until, at most, two days before the bids were opened. Tears Save Man and ' ' Wife From Jail Cell; Accused of Con Game i When the city prosecutor in Cen tral police court read yesterday a charge of vagrancy against Glen McDonald, 50 years old, and his young wife, the husband shed tears and made a plea which included a story of the death of his two sons, twins, at the battle of Vimy Ridge. They were discharged on condition that they leave Omaha. A telegram from Denver police alleged that McDonald and his wife played a confidence game of their own. Upon arriving in a city they deposit a large sum in a bank to be used to establish pprsonal credit, police say. . They then make "purchases for which payments are made with checks. The money deposited is withdrawn before the checks pass throutrh.the clearing house. :. ,. McDonald is partially blind. . He and his wife .were - fashionably dressed. Mrs. McDpnald put up a $1,000 bill for her release following her arrest. Her husband remained in jail over night. I- ii Man on Parole Tried To Bribe Him, Police ' Officer Tells Juclge Frank Sellers offered him $3,000 or a barrel of whisky if he, would act, as "lookout" while Sellers and a job of highjackers were doing a job of highpacking, Police Officer Trapp testified in District Judge Redick's court yesterday. The hearing was for the purpose of having Sellers' parole revoked. Sellers was arrested on a charge of automobile- stealing. Ma 15, 1917, and paroled. Chief Deputy County Attorney Coffey held that he has broken the terms of his . parole. Judge Redick took the case under advisement.
