"It's the rottenest deal that was ever-put over on the people of Douglas county, and we are now preparing to take action, in the courts if necessary, to stop it." These were the indignant words of W. B. Cheek yesterday, regarding the action of the board of Douglas county commissioners, in awarding a contract last Tuesday for paving the Lincoln highway, from a point half way between Elkhorn and Wa terloo to thi Dodge county line with "bitulithic," a composition at $4 a square yard," he said. 'This would have amounted to $4224 a mile. It would be a better paving, I believe, than concrete with the bitu lithic topping. Then, later on, the brick could be laid on top of the concrete." Mr. Cheek stated that the action to be taken to prevent paving any county roads with anything but pav ing brick will probably start next Monday. The precise nature of this action has not yet been decided on, but the committee is working on it Mr. Brogan declined to be quoted, but referred to the pledge signed by the five county commissioners be fore the paving bond election. Committee to Report On Municipal Hospital Appointed by Mayor In compliance with a resolution adopted by the city council Tues day morning, Mayor Smith has ap pointed m committee to investigate the need of a municipal hospital and make recommendations to the city council. Gyger, Fort Omaha Enlisted Men Given Chance to Enter the Air Service Fort Omaha enlisted men as well as commissioned 'officers will bene fit by the establishment of posts for specialized training for army air service personnel, as provided for in a program approved by Secretary Baker Thursday, according to Lt. W. T. Burns, adjutant at the fort. "It is an opportunity for enlisted men to get training of the highest next two weeks, and will continue to send them in groups about twice a year. "To, qualify, the men must take a severe mental and physical test. They will be 1 sent to Ross field, Lee Hall, Va., and Brooks field. California. The establishment of these posts will interfere in no way with the activities at Fort Omaha." Carranza-Yaqui Peace Conference of No Avail Douglas, Ariz., Feb. 27. Tele graphic advices reaching here today from Hermosillo, Sonora state capi tal, conveyed the information that the Conference to arrange a tenta tive, peace between the Carranza government and the various units of Yaqui Indians warring in the state of Sonora, failed yesterday when Yaqui representatives with drew. "It was upon this proposition and promise that the people of the county voted the bonds. The present action is abso lutely a breach of pledge." The pledge is to be found in the comity archives. It vas written and signed by the five county commis sioners May 9, 1919, and, without the preamble,, is as follows: " . . . For the purpose of meet ing this situation, the undersigned constituting the board of county commissioners of Douglas county, Nebraska, do hereby state, agree and pledge that if the said bonds are Voted, the proceeds thereof will be expended only in the construc tion of brick paving on the high ways described in the ' resolution adopted May 1, 1919, by the board of county commissioners of Douglas county, Nebraska, and substantially in the order named in the said reso ition." But Five Miles of Brick In spite of this pledge, the county commissioners asked and received bids for "bitulithic," concrete, as- phalt and brick paving. ; When the bids were opened last Tuesday there were found to be four bidders, these covering only part of .tho roads on which bids were asked. , That afternoon the commissioners awarded contracts to the Allied Contractors, Inc., for paving the T inrnln hiirhwav from thf enA of the present paving to the Dodge county line, a distance of a little more than 17.33 miles. ;, Only 5.33 miles of this is to be paved with brick. He ' said, however, that lit would be "good" paving. Composition 5 Cents Lower. The price at which the brick pav ing contract was let was $5.25 a square vard or approximately $55, 1)00 a mile. The price for the "bitu lithic" was $4.35 a square yard, or approximately $46,000 a mile. The bid of the Allied Contractors, Inc., was just 5 cents lower per square yard for "bitulithic" than that of William Horrabin of Iowa City, la. It was 10 cents per square yard lower than that of the Hugh Murphy Construction company. The county commissioners' rea 'son, given for paving more than two-thirds of the first stretch of Douglas county roads with "bitu lithic," is that they can't get enough brick. "We' can't get more than enough brick to pave four and a half miles of Douglas county roads with bride this year," said Commissioner Neble. "How do you know that?" he was asked.
