Slabaugh, president of the Douglat Comity Bar association, with the members of the executive committee of flic association met at noon , yesterday in Mr. Slabaugh's office and decide to call a meeting of the members 'of the associatior and the lawyers rf Washington and Burt counties this noon in the Douglas county court house to name a lawyer or lawyers as can didates for appointment to the dis' trict bench to take the place of Dis trict Judge "Day, who has been ap pointed to the supreme bench. This action was taken at the re quest of Governor McKelvie in a letter to Mr. Slabaugji Wednesday. Goss Withdraws Petition. Charles A. Goss, wlio was out with a petition asking tf governor to appoint him to the place the morning after Judge Day's appoint ment to the supreme bench was an nounced, is reported to have cabled in his petitions. - Governor McKelvie stated in his letter to Mr. Slabaugh that he didn't think much of the petition route to the job. "The lawyers shouM assemble and, by se cret ballot, indicate a man or men whom they consider suitable judicial umber." The governor stated that he hopes the members of the bar can agree on one lawyer suitable and willing to take the place. If this cannot be done he asks the bar to submit two or three names from which he can maki aselection. Dozen In the Field. A. S. Churchill was mentioned to day as a possible candidate in addi tion to at least a dozen already in the field. Mr. Slabaugh stated that Burt and Washington county lawyers will be called to the meeting, as well as law yers of Douglas county. The tele phone will be used in reaching the lawyers in these other two counties cf the district. Mr. Slabaugh said he himself wou!d not be a candidate for thi place. Samardick Retained By Eberstein After 10 Days' Suspension Robert Samardick, who was sus pended from the police force by Chief Eberstein following a raid he conducted December 20 on the Bert Fox home, 1903 Emmet street, was allowed to return to work yesterday morning, after a suspension of 10 days by the chief. Samardick was accused of arrest ing, without just cause, Mr. and Mrs. Fox and Mr. and Mrs. N. W.1 Green in the raid, and of violent be havior while in the Fox home. The charges were filed with the city council, and upon the sugges tion by Mayor Smith it was voted yesterday morning to place the case before the chief of police for final dis position, since the policeman had been on the force less than six months and was not entitled to a hearing before the commission. Samardick insisted he did his duty in raiding th Fox home and tliat he was guilty of no miscon duct while in the house. When told of Chief Eberstein's decision, he declared he was uncertain whether or not he would return to work. "I do not think. I will accept the decision of the chief," he said. Dravich, 1610 Capitol avenue, was broken Thurs day night and $500 worth of suiting material stolen, a report to police states. A suitcase containing a toilet set, clothes and a watch was stolen from the home of J. S. Donahue, 824 South Twenty-fourth street, during the absence of the family Thursday nighf The loss is $200, Mr. Dona hue said. Entrance to the home was gained through a rear window. A prowler entered a room on the ninth floor of the Hotel Conant, oc cupied by Otis Earl, 410 Keeline biulidng, some time during the night and stole Earl's trousers. They were found later on the sixth floor of the hotel, but $65 was missing from the pockets. A hypodermic needle and $17 in cash were stolen from the Noyes pharmacy, 101 North Fortieth street, by burglars who broke into the place Thursday night. A panel in the rear door was kicked through. Takes Jury Just 15 Minutes to Free Man Accused of Rioting A jury ,in 15 minutes yesterday decided Perry Jenkins not guilty of conspiracy to murder Will Brown, negro, the night of the court house riots. Jenkins was arrested October 3 and has been in the county jail since that time. He was a ticket seller with the Con Kennedy carnival which arrived here the night of the tiot. He testified that he spent all the time of the riot in the Gayety and two moving picture theaters. The state lacked proof to show that he was even in the vicinity o! the court house during the riot. Divorce Courts Sophia Hoffman was granted a divorce from John Hoffman in di vorce court by Judge Day on grounds of cruelty. Allegations of cruelty won di vorces in divorce court for William Boning from Mary Boning; for Irene Chase from David Chase; for Grace Jones from Richard Jones, and for John Kirley from Marie Kir ley, Judge Day signing the decree in each case. Morris Shack was given a di vorce from Gladys Shack by Judge Troup in divorce court on allega tions of desertion. Mike Shapiro told the district court in a petition for annulment of his marriage that Mollie Shapiro forced him to go through a marriage ceremony with her at Hot Springs, S. D., June 26. 1919. He alleges that she did this "to use him in connec titon with other unlawful scheme then being carried on by her." He says they never lived together as husband and wife. Ella Olohan was granted a di vorce from Bernard Olohan on charges of nonsupport, Judge-Troup signing the decree. McKintey Cunningham sued his wife, Etta Cunningham, for a di vorce in district court, charging that she abandoned him two years ago. To Consider 1920 Budget. The city council will sit next Mon day to consider the 1920 budget ap portionment. The last levy of 35 mills will yield a general fund of $1,950,000, to which will be added an estimate of $350,000 for miscella- neous collections, making a total of $2,300,000, which will be distributed among the various city departments. An overlap of $150,000 in police and fire funds for 1919 will first be deducted. i I J?
