fHE OMAHA' SUNDAY BEE:. DECEMBER 28, 1919. 7-A IIOLMDERG WILL LEAVES NOTHING TO SECOND WIFE Efforts of Divorced Widow to Secure Estate Apparently Blasted by Filing Will Following Decree. "X- - .; A bombshell was dropped yester . day upon the well-laid plan of Mrs. Augusta Holmberg to get posses sion of the estate of her divorced' husband, Peter Holmberg. The will of Peter Holmberg was filed in county court, duly signed, witnessed and sealed on October 25, 1919. That. was the day after Pe ter secured a divorce from Mrs. Augusta Holmberg. He secured the divorce on the ground of cruelty. They had married in 1914. when he was 72 years old and she 54 years old. He said he thought she would .make his declining years comfort- able, but he alleged she did the op posite, making fun of him,' refusing to go to church with him and threat . ening to send him to the poor house. Found Dead December 12. -He was found dead bv accidental asphyxiation December 12. On the day after the funeral Mrs. llolmberar appeared in county court and asked to bt appointed administratrix of his will and reported herself the sole heir en the ground that the statu tory t six months had not elapsed since the divorce decree was granted Mr. Holmberg, and that, thfrefore, she was still his legal wife. Mf. Holmberg's will was drawn by ' Attorney Tohn W. Battin. His sec ond wife, Augusta, is not mentioned in it, but he refers several times to "my beloved first wife, Johanna Pe terson Holmberg, deceased.'' ' He leaves $200 each to six neph ews and nieces, children of his first wife' lister. They are Mrs. Charles Swansoh. Red Oak,. Ia.; Mrs. John Esaias, Yorktown, la.: John Carlson, Red Oak, la.; Alfred Carlso.i Essex, la.; Swan Carlson. Essex, la., and Frans A Carlson, who lives in Sweden. Nothing to Niece. . The will stipulates that nothing shall be paid to another niece, Mrs. Andrew Gustafson Council Bluffs, Ia. ? . He beaueaths $600 AO the , First Swedish Methodist church of Oma ha where he was a faithful member for many vears, as as memorial to .his first wife. John W. Battin is named executor of the .Will. " Mr. Battin declares that Mrs. Augusta Holmberg cannot get a penny of the estate. Ross Shotwell, attorney for Mrs. Holmberg, de clares that she is entitled to all the persona! property and a life interest in the real estate. The total value qj the estate is about $4.000. Fate to Get Child From Flanagan Home Pending Divorce Suit The domestic troubles of Samuel and Gillian Goldsmith were recorded in another chapter in dis trict court yesterday, when Judge Redick issued a writ of habeas cor pus allowing Mr. uoiastmtn (osses sion of 10orear-old Michael Gold smith from Father Fbnnagan's home, where he was placed pending the Outcome of the divorce suit, filed October -20. ' A week ago Samuel was haled into court for not paying temporary alimony of $100 a month-to his wife as ordered by Judge Troup. Mr. Goldsmith formerly kept a taloon on East Douglas street and is now in the garage business. His wife still lives in their home, 4302 Dodge street, and he lives at the Wellington Inn. ' I Divorce Courts petition for divorce filed in district court that his wife, Phoebe Wil liams, will not come to Omaha and live with him, although he has of fered her a home and railroad fare. Thev wert wedded at Camp Cody, N. M., June 40, 1918, and' she re turned soon thereafter to Los An geles, her home. ' Mary IS. Taylor says her husband, Clarence, treated her with cruelty ' during trir married life of 17 years. ' Shi applied to the district court for a divorce, alimony and - custody of their two children. - . Allegations of 'cruelty and drunkenness won a divorce for Rheuminie Unangst from William Unangst iri divorce court, Judge Day signing: the decree. ' Lloyd Asdell applied to the dis trict court for a divorce from Hattie Asdell, charging her with extreme cruelty. They were married in 1909. Martha Cole was granted a di vorce from Mr. June Cole by Judge .Sears in divorce court on allegations of nonsupport and cruelty. She was restored to her maiden name, .Hall. .. Iva Taylor secured a divorce from ' Scott Taylor in divorce court on the ground of nonsupport and ex treme cruelty. Carges of extreme cruelty won a divorce for Thona McCann from his wife Margaret McCann, in di vorce court, Judge Sears signing the decree. "Elva Hunter was given a divorce from Irl Hunter in divorce court by Judge Sears on grounds of nonsup port Custody of a child was given . to her. . .
